As far as I know , if you are married you need to file married, whether it be married filing separately since your spouse isn't living with you. Or getting an ITIN number and filing jointly.

I filed head of household because I had dependants , but that I think is the only way of filing while married. If you file single , you will probably have an issue.

Hi even tho we just got married this year? For his tax return last year he filed it single but for this year hes filing it married. Do you think we did the right thing?

How can my husband put married on his tax if i do not have a SSN yet bec I have not lived in the US? They will ask for the spouse's SSN. So my husband put single. Are we going to have an issue bec of that? My husband told me if they ask tell them the true answer.

2014-07- 21 - Status updated still AP 2014-07- 23 - My husband went to the house of Senate and they attended to him right away.

2014-07- 24 - The asst. at the senate responded immediately and contacted the USEM.

2014-07- 28 - Status updated still AP (received an email from the USEM, 1. Applicant, your case is ready to be issued, but your passport #********** needs to be cancelled first & returned to our office at your earliest convenience. Please contact visasbkki@state.gov to pick up your old passport to complete this step.)

2014-07- 28 - Cancelled my old passport and sent them to the USEM.

2014-08- 13 - Status updated still "READY" I sent them an email re the ready status. Aug. 11 & 12 National holiday USEM closed.

2014-08- 14 - Status updated still "READY" I received an email from the USEM,We have received your said documents. Please be informed that your visa has now been approved. We are working with the preparation of your visa package and will mail it to the applicant address on GSS profile which takes approximately 7-10 days. Applicant should refrain from making any irrevocable travel arrangements until he/she receives.<p>

This is a common error and rarely causes issues... However, if you are married... You need to file married. Many HR Blockheads will tell you that if they are not in the USA then it is single... They are WRONG. Married is married and you should file married. If the spouse is not in the USA then you file married filing seperate and put NRA (non resident alien) in the spouse SSN block. You can amend later when they arrive. If you filed single, you should file an am emdment... As far as immigration they will not really care unless, your proof of bonifieds are borderline... IRS doesn't care if you pay them more tax (as you are filing single ) ... But to be correct... If married, you need to file married, period.

But how to approach this when you live abroad and have no income ?

Well, as another member said, married is married is married-not single. When my husband was not here and I had to file taxes, I filed MFS (Married Filing Separately) and in the place where it asks for spouse SSN, put NRA (Non-Resident Alien), this accounts for the foreign spouse not having an SSN or ITIN.

This is not about telling them the truth, it's knowing how to file taxes correctly and accurately. Some will suggest it is okay to file single, but this is incorrect- especially for those spouses who will need to ROC (Removal of Conditions-you may need to provide tax transcripts as one of portion of evidence).

We called the IRS and they sended 3 non-filing letters from the past 3 years for my U.S. wife.

What i dont understand is : we are living in the Netherlands , i work but my wife isnt.

i file my taxes in the Netherlands and we file here married . She has her own dutch SSN number here in the Netherlands.

Why do we also need to file at the IRS in the states ? Do i have to pay dubble taxes then ?

I filed married filing single but my deduction for my wife was denied because she has no SS # or ITIN. Will this affect my interview? And can I get that money back? I put "NRA" (Non-Resident Alien) for her SS #.

U.S citizens working abroad still need to file their taxes and report income. Perhaps you should talk to an immigration tax lawyer.
