AOS sent. Emergency advance parole?

Hi everyone!

We sent in our AOS a week ago and we finally recieved our notice. It does not say we were approved, it only said they'll be sending an email if he is ready to do the biometrics. Is that normal?

Also, we are getting married in the philippines in December and we are worried we might not get our green card prior to that. Do you suggest turing in an emergency advance parole now, or wait for few months?

Adjustment of status takes about 4 months, sometimes less, sometimes more. You should expect to receive a notice within the first few weeks with an appointment to go get your biometrics taken, then a few months later, another notice with a possible interview date or a decision. Some people don't get interviewed at this stage but I believe that most of us do.

You cannot apply for an emergency advanced parole if your only reason is the wedding. That is not an emergency.

AOS does not give you an instant approval. And wanting to have wedding ceremony is not an emergency, so you cannot ask for emergency AP for that reason. http://www.uscis.gov/green-card/green-card-processes-and-procedures/travel-documents/emergency-travel

You have a 50/50 chance of not having an interview when adjusting from a K-1. Those that do not get an interview typically have to wait longer for the green card approval. AOS processing times are varied, from 4-10+ months. Did you file for the EAD(I-765) and AP(I-131) with the I-485? You will first be sent your biometrics appointment letter. You will go to that, and then wait some more. The EAD/AP is received in about 90 days after filing. You would have the AP before Dec., if you have not received the green card yet.

If you did not file for the EAD and AP yet, then go ahead and do it now. The fees are still waived when you have a pending I-485. Just be sure to include a copy of your I-485 receipt notice with your EAD and AP forms.

We did get the notice today. Hopefully the process won't take long cause we had planned the wedding even before he flew to the US. We should have thought about this. :( thanks for the reply!

Hi! Yes we did include the travel and work authorization along with the AOS. We received 3 notice today. What do you mean by EAD/AP is received after 90 days? I thought it usually gets approved within 90 days? Also, if AP gets here before our trip, we could use that for him to leave the country right?

We should have thought about this.... I want hit my head with a hammer. :( everything is sorted out back home and they're just waiting for us to be there. Hoping and praying our papers get approved before our wedding!!

First off you can't get married in the Philippines, the main requirement of the K-1 visa is to get married in the USA. You can however re-new your vows, but no marriage license.... as you are already married.

EAD/AP card can take 2-4 months, green card can be 4 - 12 months on average.

First off you can't get married in the Philippines, the main requirement of the K-1 visa is to get married in the USA. You can however re-new your vows, but no marriage license.... as you are already married.

EAD/AP card can take 2-4 months, green card can be 4 - 12 months on average.

We already got married here in the states (2months now). Our family wants to throw us a wedding there since they weren't present.

I can already use that AP card by then right? To travel? I hope we get it just in time before we leave! :(

You can do a renewal of vows and have one heck of a party!! :thumbs:

Yes you can use the AP card to travel back to the Phils. Don't want to leave the country without at least the AP card, if you do it will be a start over ...

My wife got her EAD/AP within two months of filing AOS and had her GC in 4 months.

I said in about 90 days. Some have gone over the 90 day mark, but typically they are received right around the 90 day mark or a little under. So, you would have your AP around the middle of August, and you are not traveling till December. You may even get an interview before Dec, and have your green card by then. No way to know just yet.

You can't do the whole 9 yards as that would involve a marriage license & certificate, you can do everything but the paperwork.

Well let me put it this way... IF you fly before receiving, at least, the AP card he will NOT be re-entering the USA... and you will have to start over with a new petition.... not a pretty though.

Yes. We definitely need to wait for his AP card before flying back home. Our tentative date is first week of November. Do you think it'll arrive by then?

Hmm.. Is that so? We got married civilly here in the US and planning to do a catholic wedding at home for formality purposes. That's a no?
