Hello All:

Please advise me of the following:

My fiance and I just got married in San Diego, CA. And I already obtained SS card and the I-94 for her. The I-94 has the same expiration date (3 months) as with her K-1 visa.

Besides applying the ID card for her, the main thing is to apply for the Green Card for her.

However, I don't know which document will be good for her to move around (say the immigration/police officer stop and ask her) or to register school?

The K1 visa is null and void after POE. It's the I-94 that defines the 90-day authorized stay of a K1 visa holder. After the I-94 expired, your wife won't have any valid immigration document. That's why it's highly advisable for a K-1 to file for AOS as soon as possible. The NOA for I-485 is her next valid authorization of lawful stay in US before an EAD/AP card or GC is issued. Her passport is only good as an ID.

For enrollment in a university, you would have to check with the school as the eligibility varies for non-student visa holders. I remember a thread before that required the K-1 visa holder to show her GC, but maybe the EAD/AP can be acceptable as well.

On the same subject, do I HAVE TO file the I-130? Is there any extra benefit to it?

Besides the I-485, I-864, G-1145 needed, as indicated by VisaJourney, do I needed any other govermental document?

Your wife came to US on a K1, right? No need for you guys to file for I-130. But there are other documents besides those mentioned, follow the VJ guide for AOS from K-1: http://www.visajourney.com/content/k1k3aos

Also, since the processing time for I-485 may take about 6 or more months, it's highly advisable that your wife also applies for the EAD (I-765) and AP (I-131), as mentioned in the link. The fees for EAD and AP are waived if you apply with AOS.

Edit: Do check out the USCIS site for updated versions of the forms. :)
