1-864 Part 3. Information on the Immigrant you are sponsoring

Hey guys, I need some help.

Iam filling out the 1-864 as the only joint sponsor. The US citizen iam joint sponsoring is married with 3 kids and bringing his wife who also has 4 kids from another man(deceased). Iam married with 1 child, a husband and have 2 other dependents. (parents).

Iam confused about part 3.

1. What does it mean when they say Do not include any relative listed on a separate visa petition? The wife and kids are all on same petition? but different numbers? Or is each person considered being on a different petition ?

2. Do i list all 5 on same 1-864 where it asks for Family Members or do i fill out one for each of them?

I also need help counting household size in Part 5.

This is what i got in the checklist

In Part 3, Information on the Immigrant(s) You are sponsoring, please correct the following...
[x] Item 7. The total number of immigrants listed in Item 7 must equal the number of immigrants listed in Part 3, Items
1 through 6.f. In addition, you must also verify that the total number of immigrants listed in Item 7 matches the
number you entered in Part 5 Item 1.

You are not joint sponsoring ANY US Citizens. You are doing one USC a favor by joint sponsoring his wife and 4 step children. He and his children have no impact on your affidavits of support. You are only sponsoring immigrants.

Before going further, if you and your husband file taxes jointly, you'll provide an I-864 from one of you and an I-864a from the other, for each of the immigrants, so a total of 5 forms from each of you. Your household size for income qualification will be 10 requiring a current minimum joint income from you and your husband of $59,687. However, on no single affidavit will the household size total ten. If you do not have that much current income, you will not be qualified to sponsor five immigrants.

Your first mistake was to use common sense and logic in completing the affidavit, instead of obeying the instructions. In a spouse (of US Citizen) and step children case, each intending immigrant has their own petition, so you will not be listing any additional family members on any of your five sets of affidavits. You'll be providing five separate sets of I-864 and I-864a, one for each immigrant.

My suggestion is to complete one I-864 and I-864a for the immigrating spouse, then edit it four times to make it correct for each of the other immigrants. You sponsor one immigrant per affidavit so, your household numbers will add up to six on each affidavit. Since all five sets of affidavits will be evaluated together, the NVC staff and Consular officer will know to apply the 10 person income requirement.

You only need to submit one set of supporting documentation, to include at least one complete copy of tax return including W2 forms etc. or the 2013 Tax Return Transcript. Submitting three is optional. Do it if you think it will help. Submit evidence of current income, such as a current pay stub for each of you. Submit also, a copy of either your Certified Copy of US Birth Certificate, Naturalization Certificate, Green Card or US Passport data page for you and for your husband.
