Hi!

Ive been posting in other forums, but heres an intro

im from california, my so is israeli. we met when i was studying there in fall of 2005, and started dating then. hes since graduated college, and now works in high tech, while im trying to finish up school here in the states. we want to be together for the last year and a half or two years i have of grad school, and since i cant finish there, were trying to get him to come here.

we just started on the application, and ive got a lot of questions. it seems relatively easy

my biggest question is about after. if, 2 or 3 years, after he moves here, we want to move to back to israel... is that an issue? esp if its before the 2 year anniversary? or does it not affect his status or green card?

To answer your question (although you may want to ask in the AOS forum), I believe that a permenat resident has to be living here, maintaining their life here. If your soon to be husband leaves for an extended period of time, like moving back to Israel, then he may forfeit his permenant resident status.

A few years after the 2 year green card, he can apply for US citizenship. After that, you guys could move around without worrying about him losing his greencard. That's what we're planning on doing.

From the USCIS:

Maintaining Permanent Residence

Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

*Move to another country intending to live there permanently.

*Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

*Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

*Fail to file income tax returns while living outside of the US for any period.

*Declare yourself a “nonimmigrant” on your tax returns.

Your husband will need to become a US citizen in order to move back to his home country and then return to the US to live again sometime later.
