Because he was already in deportation proceedings.

The IJ could and often does still allow adjustment in those circumstances.

You can expect much closer inspection of the validity of the relationship, especially where the marriage is after the proceedings have started for obvious reasons.

If the United States allowed all visa overstayers and EWIs to remain here, with a green card, what sort of message would that send to the illegals currently living in the US without permission....within moments, our churches, chapels and city halls would have lines going around the block 15 times...in the meantime, all those waiting their turn to immigrate LEGALLY but outside the US...do what? Fume? To what purpose? What would that say about our current visa laws? Why refuse anyone if all they have to do to gain a green card is marry some USC? What would be the point to maintaining the security of our borders? Just let everyone in...and wait for them to get married.

Sorry, but this guy knew the rules and chose to ignore them (and perhaps others as well)...

Funny how the nightmare everyone is so glad to avoid is the daily reality for hundreds of thousands of American citizens like me, hundreds here on our very own VJ. If he didn't want to be deported, he shouldn't have overstayed the visa. He's getting what he deserves. Anyone who tells CR-1 and IR-1 people to quite whining has to agree with me on this or else they're a total hypocrite. And as usual, no story on the hundreds of thousands waiting without their spouses like me.

That's just terribly cruel.

Your story will have a happy ending in due course. This couple can't see any kind of reunification for themselves right now.

Stop seeing this immigration stuff as all black and white. It's just not that simple when family is involved.

Our journey together on this earth has come to an end.

Because it is a privilege. I find it interesting that in a forum like this there are so much animosity towards other immigrants, whereas one might be forgiven for thinking this would be a place where people would support others going through the same process.

I believe the British call it 'pull up the ladder Jack'.

Absolutely wrong. Her reunification path is the same as mine now, with 1 added extra step, "payback" if you like for the 15 years he got off Scott free. She now has to file an I-130, like everyone else, and then when it comes times for the interview he'll get denied on the basis of his travel ban and then she'll have to appeal the denial with a hardship waiver, which will probably be granted if done correctly. Why should we have to wait in line and deal with the embassy, AP, etc. and she should not?????

According to the story he is on a lapsed non immigrant visa. If he was an immigrant why did he not seek that status?

It is not. Her path is hers and as yours is yours; one not affecting the other. I fail to see how one can derive solace in the setback of others, but it has been a while since I have been out of elementary school.

She has to file an I-130 for a spouse who is not in the country. How is that not the same path as mine?

Crying myself to sleep wishing my wife was with me and thinking about getting put into "administrative processing" for years after our interview at the embassy usually does the trick for me, but thanks for asking.

By the sound of it his case is much more complicated, it would seem that a US judge did not find evidence of his relationship compelling for a start.

So then she needs to provide that evidence in her I-130, and/or at the interview. He was in the US 15 years and they've known this is coming for a while, they should have plenty of proof. And if there's not enough proof then who's to say the relationship is legitimate? If it's not then he definitely needed to be deported.
