how long???? husband visa is expired now!!!!!

Timeline

I just filed adjustment of status for my husband. The paper work was received at thew Chicago lockbox on May 9th...........my check has not cleared my account and they still say he is not in the system.

They said it takes 10 days to receive receipt number, but nothing yet. My hubby's visa (K1 visa) expires today and I am in a panic!!!

Any advice??? Thanks

Technically his visa expired upon entry. I assume it is the date on the i-94 that was yesterday. I wouldn't worry however - you've sent in the AOS application already. Nothing bad will happen to him.

First up, breathe. You got married in the 90 days, so his overstay will be forgiven even if the packet has gotten lost. Someone else will step in with more details, I'm sure, but you can refile AOS and you won't be out of luck.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

(deep sigh) Thank you. I sent the paperwork overnight and have the person that signed for it in Chicago, so I am covered there. I guess I give it maybe till Wednesday/Thursday of this week and start calling them again??

There's no harm in calling them again soon. It's also mentioned here that uscis can take up to 30 days to send out notifications. Have you also filled-out a G-1145?

yes, we filed the G-1145, so now we wait.......patiently........lol

Yeah, I have also re-calibrated my patience-meter in this immigration journey, and I thought I was patient enough. :lol:

Just watch out as well when the check is cashed, the e-notifications are typically sent out within 2 days. All the best! :thumbs:

Timeline

We mailed off our package on the 8th and 10 days later I got a text saying that the package was recv'd and the NOA to follow.

I know that sometimes these packages are delayed depending on the office in which it was filed. Try not to stress too much. I would continue to follow up and keep a positive attitude that things are and will be ok.

$1070 when I sent mine (which was last month :P)

And OP, don't worry. My I-94 ran out before we got NOA1 for AOS. I think everyone's ends up expiring before AOS is done. Don't panic ^^ like another poster said, the K1 is expired as soon as you use it, your 90 days is just the I-94. So long as you got married in the 90 days it's okay :)

-26th june 2014: biometrics appointment

-6th august 2014: EAD card production ordered!!!!
