Hello , I am currently out of status & my fiance( A US Citizen) and I are getting married in a few weeks & I wanted to make sure Im preparing the right documents. Were getting married at the courthouse for now because were definately unable to afford a big ceremony right now. After we do so We intend to file AOS package consisting of I-485, I-130, I-131, I-864, I-695 , I-765, Photos , Evidence of Joint Bank Accounts, evidence of our trips together , Phone records & text messages ( Not sure if this is necessary ? ) .. We have been together for a year now .. Is there anything else that should be included ? Also, will we be more scrutinized for marrying at the courthouse ? There will only be about 2 or 3 people there, and is there a waiting period we should be mindful of between the time we get married and the time we file? I should add that I was denied for AOS before, But it was not through marriage. My mom had filed for me while i was in the country but she was still an LPR at the time, By the time it was denied I was out of status. Will this have any effect on our case?

I would appreciate all constructive advice , Thank you

I don't think you need I-695 form! In terms of marrying at a courhouse is totally fine. Just make sure you bring some photos to the interview when it comes to it with your friends/relatives being there at the courthouse wedding as well as your spouse's friends/relatives. If you happen to have anything else that's joint (bills, car insurance, health insurance etc.) that's only better. Being denied from AOS in the past due to aging out will not have any effect on your current case. It was definitely an "intent to immigrate" but since you were a minor, it wasn't really your choice whether you dream about living in the US, or not, but your mom's. I believe, that will not have any bearings on your current vase. Wish you the very best, pal!

Thank you very much for your response.. Another question I had is does it matter if i use my maiden name for all my immigration documents when we are married ? Or does it have to be my husbands surname?
