Can i change from a student visa to a working visa?

Hi guys,

I am currently in the us on a student visa- OPT(associate degree). I have found a job that is willing to sponsor me for a working visa.

I have a few questions:

1) Do i have to apply for the working visa in the US or would i apply for it out of my embassy?

2) Can i still go to school part time and stay in the us on a working visa?

3) If i file for a working visa in the US what forms do i need to file?

3.1) How long does this process take?

3.2) How long will the working visa be issued for?

A Visa is something you get in your own country, change of status you do here.

All the other question are down to the Visa that your Employer is going to apply for, It would be very unusual if the Employer's Lawyer was not handling it.

You can get a change of status here in the US.

You can go to school part time if you want.

Your employer will supply all the needed document if they are sponsoring you unless you agreed to do it yourself.

Most of change of status from F 1 to work permit require at least bachelor's degree or special skills.

The length of time depends on the quota of work permit that year. If it reached the limit, then you have to wait until next year when more become available.

You dont't have master degree to qualify H1B visa. So apply E2 or E3 if you qualify. Now much harder to work in the USA.

Yes you can, when your F-1 visa valid.

It's depends on your qualification. If surely company sponsor, it's huge plus. I recommend contact Immigration lawyer for better results.

If you have EAD, OPT its huge plus and it's finished shortly.
3.2) How long will the working visa be issued for?

depends on visa category. You can adjust it later. be cool. contact immigration lawyer for better results.
