Hello Everyone,



My husband got orders and he will be going overseas for a year in a short tour. It is unaccompanied tour so I won't be able to go with him. After the year we will be going to Germany.



My green card will expire on August 28 and I am ready to file the 1-751 to remove conditions. Mine was valid for 2 years.



However, I think I might be able to file for naturalization since we are going overseas. I am not sure if I have to file the 1-751 to remove conditions or I can file the N400 instead, or if I have to file both the 1-751 and the N400 right away.



I have read online about the EXPEDITED NATURALIZATION for Spouses of Military Members under section 319 on the INA and it seems that it might be an option.

We haven't gone through this, but I have read where a few have. All you have to be is a green card holder. I don't know if the short tour would count and "deployed," but I don't see why it wouldn't. I would also call the military helpline to verify. Also see my reply to the other post you made. Another fairly helpful resource might be the passport office on your base. I don't know how well the stateside bases are with this, but I know I talked to our passport office on Aviano and the guy there was pretty knowledgeable.

As for your follow-on to Germany, your husband won't get those orders finalized until about 3 months before he leaves his short tour location. You will have to be sure to be command sponsored also.

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

we're you able to find out? I sent my i-751 but then 8 months later found out that my husband got orders to Japan and I will be leaving with him. My application still hasn't been processed and it looks like its going to take awhile.

 

I was thinking of instead of waiting to have that approved, perhaps I could get the expedited Naturalization so when we move in February (in 7 months), I will be already a citizen and won't have to go through all the trouble.

So go ahead and file for Naturalization if you want.
