Hi everybody,

My wife (with an L2 visa) applied for getting the EAD about a month ago. Today she received her card but we've found out that the last name written on it doesn't match with the one reported on all the other documents (driving license, passport, ssn). To be more precise her EAD shows my last name, and even though we are married she's never changed her maiden name.

What can we do to fix such issue? In case we don't will she be able to work here?

File a new I-765, but with the following instructions:

If the card issued to you contains incorrect information that is attributed to a USCIS error, a new Form I-765 and filing fee are not required. Instead, you must submit a letter, accompanied by the card containing the error to the ServiceCenter or National Benefit Center that approved your last employment authorization request.

That will only work if it was a USCIS error, hence the reason for my question.

She can just use the EAD and get a new SS card and DL in your last name if she prefers. Changing the name in passport doesn't matter as long as she travels with a marriage certificate.

She probably did fill out I-765 with your last name. If she didn't, then it would be an error on USCIS part so they should be able to make corrections without a fee and no problem.

Yes, but you'd need to resubmit the I-765 as it was your mistake, not USCIS'. Alternatively you could just use the card and not worry about it, since she's free to use either name.

She needs to get a new SSN and new DL...or a certificate that shows she legally changed her name...I think you might going to have bigger headache down the road with this. She should have put her family last name down on that form....grrrr

And she will have no problem to apply for a job? Doesn't she need to change the SSN as well?
