First,being married previous to I-129-F petition does not affect processing time,nor does filing a previous petition in the past unless you don't send evidence of divorce(certified divorce decree),and in the case of previous submission, a signed note explaining,as in my case,that the previous K-1 visa recipient was now an employed U.S. citizen. Someone with more knowledge than I can speak to the ramifications of a previous K-1 visa holder still being "covered" by that petitions I-864. In regard to evidence,while not technically required with the I-129-F petition,may be the only evidence the consulate considers before they make their decision. At my wife`s interview for example,she brought phone and text message records and my itinerary showing that I was in Thailand at the time of her interview,these items were not looked at but they DID accept and went thru every photo that she submitted, which seems to be the single most important evidence you can provide the thai embassy.Depending on the country,the !-129-F petition may be your only chance to submit evidence that will be considered by the consular officer before he interviews the beneficiary.

it is as it's required in the I129F instruction to follow when you fill the form.

we followed the instructions steps after steps, providing a full package of everything, copy of ID card, translate former divorce decree, Pics and tickets proving i was in the US + notes explaining pictures + cover letter and even a letter from his mom speaking about our relationship then they recieved in Dallas the package on May 1st (tracking number) and we had the NOA2 on May 14th from california !

now, waiting for NVC

Show me where in the I-129F instructions it asks for relationship evidence. I have read those instructions many times, and there is nowhere it asks for proof of a bona fide relationship. So, where in the instructions did you find that part?

In regard to evidence,while not technically required with the I-129-F petition,may be the only evidence the consulate considers before they make their decision. At my wife`s interview for example,she brought phone and text message records and my itinerary showing that I was in Thailand at the time of her interview,these items were not looked at but they DID accept and went thru every photo that she submitted, which seems to be the single most important evidence you can provide the thai embassy.Depending on the country,the !-129-F petition may be your only chance to submit evidence that will be considered by the consular officer before he interviews the beneficiary.

This thread is about processing times of the I-129F petition and someone stated a factor in processing times was to have plenty of relationship evidence. That would have no bearing on the processing time of an I-129F petition, since it is not even required for one to be approved. No one is disputing that for certain consulates you should 'front-load' your I-129F petition. That evidence is needed for the CO to look at for your K-1 visa interview though. It is not required to get the I-129F petition approval.

I agree with that as well. I was previously married and our I-129F petition was approved quickly. It could only slow you down if you did not provide the required proof that your prior marriages were terminated.

do you think it s wise to just meet your fiancé(e) in the past two years, prove it and then apply for a K1 for someone you're not in touch anymore? then meaning the relation is not continuing? i think you are picky on the terms ! it is implied that they want the couple to be real and obvioulsy the relation to be true and continued and not only meet once in Two years ! there's a fair well balance way to be.

so yes ! you're right they do not ask for relationship evidences they just ask for us to tell we met, obviously giving more than they 're asking helped us so i will never advice anyone to do the less when they can do the best.

inproving them the relation was continuing and give evidence of our relationship in addition that we met, make the process good for us so we didn't lose time in providing further evidences.

i'll bring just my phone to the interview to prove that nothing has changed since we applied.

i would advice people on that site to take and leave what they're reading cause each cases is different.

it took only 14 days from the i129f sending to the NAO2 notification whereas it takes weeks or months to others..; nothing is set in stone in this process. having a good background and being blessed or lucky helps more than anything else.

now we're waiting for NVC letter of instructions

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

A non complicated previous filing or marriage will not delay a new petition.

However, a previous filing with fraud markers definitely will.

We see all kinds of 'out of the normal range' fast marriages after a divorce or a quick divorce after a GC.

These are fraud 'indicators' and WILL be looked at closely which can delay a new petition.

It is not picky, it is factual. You told me it was required and in the I-129F instructions. How much relationship evidence you provide with the I-129F petition has no affect on the processing time of the petition because it is not even a requirement to be approved for the I-129F.

It is not implied that they want you to have been together more than once for the I-129F petition to be approved. You meet the requirement of the I-129F petition if you have been together only once within the 2 years prior filing. Whether that is enough to get approved for the K-1 visa at the consulate is another matter. Some get approved with a short time of knowing each other with just one in person meeting, and some do not. It mostly depends on the consulate and whether or not the CO believes the relationship is valid. As you said, each case is different.

Those processing the I-129F petitions do not decide if the relationship is valid or if a visa should be issued or not. Any relationship evidence added to the I-129F petition is solely for the CO at the consulate to look at for the K-1 visa interview. For some consulates, it is important that evidence be in there for the CO to see. It is not needed to get the I-129F approved though. These are two different stages of the K-1 visa immigration process.

Getting a really quick I-129F petition approval is mainly just plain luck, if it was not due to an expedite.

You should take evidence of relationship with you to the K-1 visa interview. That is where they decide if your application for a fiance(e) visa is valid, or for immigration purposes only. The Dept. of State approves/denies/issues the visas, not the USCIS. If you front-loaded your petition, then your relationship evidence will already be there in your file for the CO to see as well.

Most consulates do not allow cell phones inside. <-- You have said yours does, so that won't apply to you personally, but might to others. Not sure the CO would be willing to look at the evidence contained in your phone, but I suppose you can always ask. EDIT: nope, not going to happen, period.

A non complicated previous filing or marriage will not delay a new petition.

However, a previous filing with fraud markers definitely will.

We see all kinds of 'out of the normal range' fast marriages after a divorce or a quick divorce after a GC.

These are fraud 'indicators' and WILL be looked at closely which can delay a new petition.

This is true, but not really about simply having been previously married. It will matter if you filed a previous petition before. I would toss that vetting into the background check and IMBRA aspects.

No embassy allows cell phones inside for security reasons. Your embassy in France doesn't either.

You have to check it at the front with the guards and you can not bring it to the interview.

From your own consulates instructions:

No drinks, food, electronics (including laptops) or big suitcase allowed in the Embassy. Electronic devices like USB keys or cell phones are taken at the security check point, but phones are available inside. No laptops are allowed inside AT ALL - if you try to bring a laptop you will be told to deposit it somewhere and come back.

Leave your suitcase at hotel.

Else there is a "consigne" at "Gare de l'Est".

The part that says "but phones are available inside" infers that there are landlines available.

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

This is true, but not really about simply having been previously married. It will matter if you filed a previous petition before. I would toss that vetting into the background check and IMBRA aspects.

Agreed, that was what I was talking about. Having been previously married = no issues.

Fraud indicators surrounding a previous marriage to another beneficiary = delays with potential IMBRA aspects and background checks.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

No embassy allows cell phones inside for security reasons. Your embassy in France doesn't either.

You have to check it at the front with the guards and you can not bring it to the interview.

From your own consulates instructions:

No drinks, food, electronics (including laptops) or big suitcase allowed in the Embassy. Electronic devices like USB keys or cell phones are taken at the security check point, but phones are available inside. No laptops are allowed inside AT ALL - if you try to bring a laptop you will be told to deposit it somewhere and come back.

Leave your suitcase at hotel.

Else there is a "consigne" at "Gare de l'Est".

The part that says "but phones are available inside" infers that there are landlines available.

I had read something about London allowing phones in now, so I thought perhaps others might be allowing them now as well(and I did not know which consulate they were going through). I went to check and it seems they are allowed at London now, but they have to be turned off when you go in, so no CO would be looking at phone evidence anyway.

But, since you checked on that person's consulate, it doesn't matter to them anyway. No phones.

It is not picky, it is factual. You told me it was required and in the I-129F instructions. How much relationship evidence you provide with the I-129F petition has no affect on the processing time of the petition because it is not even a requirement to be approved for the I-129F.

It is not implied that they want you to have been together more than once for the I-129F petition to be approved. You meet the requirement of the I-129F petition if you have been together only once within the 2 years prior filing. Whether that is enough to get approved for the K-1 visa at the consulate is another matter. Some get approved with a short time of knowing each other with just one in person meeting, and some do not. It mostly depends on the consulate and whether or not the CO believes the relationship is valid. As you said, each case is different.

Those processing the I-129F petitions do not decide if the relationship is valid or if a visa should be issued or not. Any relationship evidence added to the I-129F petition is solely for the CO at the consulate to look at for the K-1 visa interview. For some consulates, it is important that evidence be in there for the CO to see. It is not needed to get the I-129F approved though. These are two different stages of the K-1 visa immigration process.

Getting a really quick I-129F petition approval is mainly just plain luck, if it was not due to an expedite.

You should take evidence of relationship with you to the K-1 visa interview. That is where they decide if your application for a fiance(e) visa is valid, or for immigration purposes only. The Dept. of State approves/denies/issues the visas, not the USCIS. If you front-loaded your petition, then your relationship evidence will already be there in your file for the CO to see as well.

Most consulates do not allow cell phones inside. <-- You have said yours does, so that won't apply to you personally, but might to others. Not sure the CO would be willing to look at the evidence contained in your phone, but I suppose you can always ask. EDIT: nope, not going to happen, period

i said cell phones are allowed in my embassy, i will bring it and if i'm asked to let him switched off or somewhere, i will of course ! it's common sense

i won't be satisfied myself with few evidences,i will bring more than that of course and all information they are requesting, even more like my own background due to my specific activity

i just said it was implied that somehow the relation has to be valid and currently going when applying for the K1 if not why applying !! LOL

going on the Department of States, it appears the NVC Transfers the file and approval to the embassy where lives the fiancé(e) then it took between two and 4 weeks to be sent to the embassy and then the longest might be to have a schedule

in my situation i'm supposed to visit my love in June and we may not have the letter from the NVC and waste time though till my return in august ! so we wonder what to do as not knowing is not fun
