Hi everyone! I'm here to ask for any advicE especially a legal advice. To make my story short, I arrived in US thru a k1 visa and got married way back Dec2011 but marriage did not work out so I decided to go home in the Philippines last Jan2012. I did not able to file any adjustments of my status. So I went back home with nothing and I was devastated back then. I know that our marriage will be no longer work cos I did everything for him, he abused me mentally, and he always kicked me out just because of misunderstandings, a lot of reasons that I don't even wanna mention anymore. He is just not good. He was married to a filipina woman before and it only last couple months just like what happened to us. But, things happen I moved on and happy now. I finally meet someone who truly love me for better and worst. And we wanted to start a happy family together in future. Now my questions are;

1. Is it possible for me to file a divorce even I'm outside in the country by just having a lawyer who will represent me? (MarriedinVirginia,USA)

2. I only I stayed there for 5 months I think. Would it be still possible?

3. How much it will normally cost if we file the divorce uncontested?

4. It is also possible for me to file a tourist visa? if its possible for me to file the divorce.

5. Please if you know anyone who can help me with my case, please feel free to message or comment.

6. Legal advice much appreciated or any help would be great.

Not sure that would help as I think it would not be recognized locally. Don't you need an annulment as well. Better I believe is if he filed.



2. I only I stayed there for 5 months I think. Would it be still possible?



Normally you file where you are resident.



3. How much it will normally cost if we file the divorce uncontested?



No idea.



4. It is also possible for me to file a tourist visa? if its possible for me to file the divorce.



Separate issues, you can always apply.

Its possible to divorce from outside the USA. Plan on spending thousands. Why not let the USC file the divorce? You wont get anything anyway so why fight it? Uncontested cost would be a few thousand depending on where its done. My husbands cost about 5 K in Calif many years back.

Tourist visa? You have already demonstrated your intention to live in the USA and that you aren't tied to the P I so you will have a difficult time getting approval. However you can apply as many times as you want.

I am hope your new relationship works but you didn't say if that was with another USC. If so plan on some problems with USCIS. The fact that you went back on your own will help you next time. Be very careful with next time !

You cannot file for divorce if you want the divorce to be recognized in the Philippines it does not matter if the divorce is from the US.

I believe that for your divorce to be recognized by the Philippine government it must be him, the non-Philippine person who initiates it. If you initiate it the divorce will not be recognized by the Philippine government. After the divorce is final in the US you must file with the Philippine government to have it recognized there. You are looking at a long process.

Maybe Hank will come by with more specific advise for you.

I am confused...you say you married in December 2011 and then went back to the Philiippines in January 2012. How is this 5 months of staying? Seems to me like a month, but maybe I'm missing out on something. Anyway, you'll have a hard time getting a tourist visa, let alone do any kind of immigration because of the past issue. It might going to bite you and indicate to USCIS that you are desperate to immigrate to US since even now the second person is from the US. Good luck!

Yes.

$450.00 U.S dollars and it will only take 3 months. Yes its that's cheap because I got it done so I know from personal experience.

4. It is also possible for me to file a tourist visa? if its possible for me to file the divorce.

It might be hard but you can do everything to file a divorce via email and fax and you don't even have to show up to court :)

This might be a problem cause if this is the case then the marriage is not considered uncontested because he has to sign the paperwork to be a speedy process.
