i will definitely be firm with my decision even if she tries to reconcile with me. she's been gone for awhile now and i don't know if i can trust her again.

what are the chances she will suceed in filing a false vawa accusation? what kind of evidence does uscis look for? our fight are always verbal and a lot of time just ignoring each other for days until one folds and apologies.

As far as I understand it she needs to prove you were abusive.

I think that's why some people suggest that you move and rent out the house because in some places, until divorce is final, the wife must be allowed access to the marital home and changing the locks can be considered abuse. If she can't find you however, that's a different story perhaps.

In this time you must be divorced.

I'd get crackalackin' on that today.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

I tried to file a divorce early but she's no where to be found and she's delibaretely hiding to delay it. My only option is to inform the uscis and file a divorce by publication.

the step of filing and then the step of granting are different steps.

can file a petition for divorce at any time.

Usually there is a court date assigned after filing, where one proves up the case to the judge.

Doesn't matter where she is - the 'publication' bits occur after filing the divorce petition.

Thanks darnell, i appreciate it. I scheduled infopass but the earliest i can get is first week of july. I also consulted a lawyer regarding divorcing by publication and was told it would cost me $3,000. Is that a reasonable fee? How hard is it to do it myself?

not hard to do yerself - get into the law library attached to (or around the corner from) the county courthouse where divorce petitions are filed, then talk with the law librarian there - telling her you want to see or purchase a template for divorce by publication . that's what a divorce attorney will use.

hey guys just an update. I finally discovered that she was having an affair and she planned on scamming me for a gc before even getting here. She left because she failed to manipulate me on adjusting her status. She is hiding now and probably looking for other ways to adjust her status like false vawa. i already filed for divorce but she is ignoring the divorce summons being sent through her emails and online accounts. I also went to my local uscis to report her but they told me i need to write a letter to the vermont office. So i did that, but i will still schedule another infopass on the main office in manhattan just to be sure. what do you guys think of her chances of still adjusting? now that i have evidence of her fraud.

I got a copy of her chat logs and some emails and them sending lewd pictures to each other. They were talking about how they love and miss each other and she will dumped me after getting her gc so they can be together. She even mentioned that she never love me and how she despise being with me instead of her lover.

As much as that sucks, sounds like decent evidence.

When you went to the local USCIS, did you talk to the fraud officer? forget the acronym for them.

i already filed for divorce but she is ignoring the divorce summons being sent through her emails and online accounts.

The divorce summons, after having been filed in Court, needs to be served upon her by a process server or other officer of the Court. Sending a scanned copy through email or any other method, even if delivering it yourself, will not be considered to have been officially delivered/received by the other side.

A process server will track her down and deliver the summons regardless of where she is, day of the week, time of the day ... and they will provide a certification that the summons was delivered to her. That's all you need to start the ball rolling - if she decides not to show up, then it just takes you a little longer and few more bumps along the way, but you can proceed and complete the process even without her cooperation. But she does need to be served the summons, any additional motions, etc.

I would also avoid emails, online accounts, telephone calls with her to minimize your exposure to VAWA-associated claims and charges.
