If you don't know where she is -- you don't have to pay a service or have someone chase her around physically or via mail to serve the summons. You have another option -- service by publication.

Go to the county clerk of court's / county clerk's office to get the proper divorce documents

  • or find a paralegal, a divorce service, or a divorce lawyer that will provide the forms and fill them out or that will do both for few hundred bucks
  • pay the court filing fee
  • do the “service by publication” according to the rules in your county
  • appear for any hearing(s)
  • wait out the required time for the final decree

Or you could use a service like this if you actual live in NY. Good luck.

I say tape her if she ever call and let her know

she did not marry U in good faith & love, never

meet up with her, let neighbors know she no longer

resides there,and keep texts if she sends any.

Inform USCIS she's gone by certified mail & go

downtown and file for your divorce...good luck

Well, all the above posts are to be taken as "the very things to do".,.,.,please do not leave any of these out, do everything thing suggested, as these people are experts, for sure.

The one thing I did not see, that due to you not filing in your timeline, what country is your "run away wife" from?

I am married to a wonderful Filipino woman, but I have been reading some bad stories on this site, about women from the Philippines. To me, they make the best wives in the world, but my friend, just had his Filipino wife leave on a one way ticket back to the Phils. and was going to Austria with another guy.,.,.,.,.

So, in short, anything can happen, do EVERYTHING listed above to protect yourself.

Please note, THIS is nothing at all about any negativity about Filipino women, my wife is from Cebu-Mindano, our marriage is wonderful!

My friend Steve, same thing, his marriage is wonderful and a 1 yr. old daughter...,.,.,.,,.

She has to go back. Even if her status was adjusted, if you notify immigration that she moved out, they would revoke her visa and deport her. They will send notices to the best address that they have available. Her status would only adjust to conditional permanent residence anyway and the condition is that she stay with you for two years.

You cannot prevent a divorce by making yourself unavailable for service. You might want to file an annulment instead. Consult an attorney. If you don't fully disclose with Immigration, you might have trouble petitioning in another girl.

The Filipinas have the lowest fraud rate of any country. I understand the there are more problems with women from eastern europe. If you married her there, then she can't remarry without getting the married annulled and that costs more money than most of the women have.

Do not tape her. In most states that is illegal and you usually couldn't use it in court even if it was legal. Don't be alone with her. Notify Immigration that she didn't stay. The burden of proof is on her to establish that she married you within 90 days and stayed with you, not on Immigration to prove that she didn't. She is good old fashioned undocumented. If she later otherwise qualified, it would be held against her that she obtained the fiance visa through fraud.

He is in New York. The recording device has to have a beep tone every 15 seconds. But if the other party hears the beep tone, they are going to discontinue the conversation. That isn't technically consent, but it effectively is. And a lawyer in this state would tell him don't even bother recording it, the lawyer probably can't get it introduced into evidence.

Back to topic which is she left, he doesn't know where she is, and he has no communication with her. He needs to change the locks on the doors, have zero contact with her by any mode, notify USCIS she left, and file for divorce. Beware if she tries to return as it may be either to set him up for a VAWA claim or to stay long enough to get the green card since he is her only way to get one.

This is not true either. There is a divorce waiver if the person can show that the marriage was entered in good faith. A person does not need to stay with the USC for two years.
