Hi, I really need your advice on this.

I enter the U.S with a visa waiver this year, married and got receipt for AOS ajustment before 90 days is expired. At the moment I am AOS pending and have not received GC yet even if my interview was back in Aug 2006. I have AP which will be expired in July 2007 and planning to go back to my country in April for a week. My question is is there any pissibility to get denied when I come back to the U.S with AP since I entered the U.S with visa waiver and filed for AOS adjustment? Is there anyone in my situation and using AP at the moment with no problem?

HI,

since you have a valid AP, there should be no problem for you when you renter the US. But since your interview was already in August, you should have your GC already. If I would be you, I would call there on Monday and figure out what's the problem. Good luck.

why are you still waiting for your greencard if you were approved? overwhelmingly they take these documents (EAD and AP) from you when you are approved.

I know there has been discussions about being concerned about using AP after AOS'ing from VWP. I am sure someone who has experienced that will come along and explain what those concerns could be.

Thank you very much for the reply.

My case is still peniding somehow even if the interviewer told us we got approved at the interview. I found out about AOS pending at the infopass 2 months but did not get any reason for that. At the interview, the interviewer didn't take my EAD or AP, but just I-94 from my passport.

Everytime I called them twice for inquiry about my case, they simply mailed me a piece of paper twice saying that they received my inquiry for I-485 for beyond the timeline and on this matter you need to ask at the infopass. My lawyer says some of his clients waited longer becuase their paper was held at the supervisor's desk, so my case should be the same pattern. However, I really have no clue why it is taking sooo long with no reason given.
