What do you do after the 5 months of wait time?

Hi everyone! On June 9th, it will be 5 months since my NOA1. I was told to call USCIS after the 5 month period and put in a service request. Additionally, I was told that the 5 month span was an "estimate" between the NOA1 and NOA2 for Texas. My question is.....how long do you get the NOA2 after the service request? Why do some cases take shorter than the 5 months? Does this mean they lost my case? What is the next step after the service request....

Sorry about all the questions....just find it mindboggling that it has taken so long and hasn't been touched since January.....

Look in Igor's List in this website for the average time it takes to do this. The average changes about as often as the wind changes direction. If you are within 30 days of the average, that means you most likely do not have a problem and should not worry.

I've looked at Igor's list.....I'm talking about USCIS (TSC) to be precise...and I'm not interested in what cases they are working on at the moment. My question is....after the 5 months of estimated processing time (which is on their website and according to the representative when I called), what do you do after you file a service request? I called and spoke with USCIS and they told me after the 5 month wait time, to call back again and issue a service request. How long do you wait for a reply? Has anyone gone through a service request? *Note: We haven't gotten any RFE up to this point*

After you NOA1, your case goes to NVC. You should call NVC now. NVC will send you your NOA2, or may be they already sent it to you. 5 months is too long. In our case, it took two months to receive the NOA2.

I spoke with someone from USCIS and they said 5 months is the estimated time between the NOA1 and the NOA2. I don't believe the NVC sends the NOA2. @HimandHer, You got yours in 2 months, but that is because the Philippines ones are taking priority due to the typhoon that happened to your country. That is why yours was a shorter time. Again, I'm looking for anyone out there who has had NO RFE's....has waited 5 months (or longer), and has had experience with authorizing a service request due to not having a NOA2.

the NVC does not send the NOA2. USCIS will send the NOA2 after your petition is approved. 5 months is the average processing time. you likely received yours in two months because you were processed at CSC or because you received an expedite. two months is not the norm for the non-Philippines filers being processed at TSC.

OP: when you are able to put in a service request, i believe the representative will give you an estimate for their response time...30 days maybe? i am not sure because i have not reached the 5 month mark yet (it's in June for me as well). If you have trouble filing the service request at 5 months - you should consider writing to your US Senator for assistance with your case.

The First Step: Filing the Petition

  • You, the U.S. citizen sponsor, must file Form I-129F, Petition for Alien Fiancé(e), with the USCIS office that serves the area where you live. See Direct Filing Addresses for Form I-129F, Petition for Alien Fiancé(e) for information on where to file the petition. Further information is available on the USCIS website under Fiancé(e) Visas. Note: Form I-129F cannot be filed at a U.S. Embassy, Consulate, or USCIS office abroad.
  • After USCIS approves the petition, it is sent to the National Visa Center (NVC). The NVC will give you a case number and send your petition to the U.S. Embassy or Consulate where your fiancé(e) lives.

NOA2 will have your case number.

Thank you, Lorella. That is the most helpful response :)

Yes....AFTER its been approved, it's sent to the NVC. But if you read my post, I have just gotten an NOA1 in January (which is not an approval). The NOA2 is the approval which is sent to the NVC. I am still waiting for the NOA2.....I think you didn't understand what I was asking, HimandHer.

i am sorry - but i think you are getting the notifications confused. the NOA2 is the form you receive when you petition is approved by the USCIS and comes from the USCIS. the NOA2 will not have the case number given to you by the NVC - because at the time of the NOA2...your case has not reached the NVC.

after your case arrives at the NVC, they will provide a case number. the NVC sends a notification letter with your case number - but again, that is not the NOA2.

glad i could help you out, ShyHazelnut. hopefully we will see some January TSC approvals soon. best of luck! :)

A service request usually takes 30 days. If you don't hear from them in 30 days you can do another service request.

You can also contact your congressman after the 5 months and have him do an inquiry for you.

You should get your NOA2 in about 1-2 months.

@him and her it took 2 months because you are from Philliphine.... and philliphina cases have priority :).

:clock:

I wish people will stop saying everyone who filed a petition for the Philippines get special treatment or have priority. That is wrong wrong wrong!!!!

I have filed a petition and it will be 5 months in a few weeks since my NOA1, and I am not the only one. Their are many who filed for the Philippines that are still waiting.

Only the people who were directly impacted by the typhoon and they have to send in proof that they were impacted by the typhoon get expedited.

Telling people that all people from the Philippines get priority is giving any body who just filed from the Philippines false hope.

Again not all people from the Philippines get priority. I wish that was true or I and many others would not be sitting waiting for our NOA2.

and then some people just get lucky, and get approved very quickly, while others have to wait, wait and wait. I am used to it now, I know the NOA2 is coming, I just have to be patient. There are some people still waiting from Nov and Dec, so I cant complain to much, they have been waiting much longer than me!!

I thank you for trying to help others, but please before you give out information, please check to see if your information is correct.

People are really depending on the information that they receive from members on VJ, just make sure you giving the correct information.

Good luck to all on this journey.

1. Members should kindly refrain from posting misinformation.

2. Philippines filers should kindly avoid assuming that what applies to them applies to everyone, whether at the petition stage or the embassy stage.

Thanks for everyone's awareness.

VJ Moderation

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
