RFE Received- Advice?

Hello VJ,

I need some advice as to what I should collect as further evidence for the RFE. This is what I originally sent in:

  1. Form I-751 Petition to Remove Conditions on Residence

  2. Check for $590 payed to U.S. Department of Homeland Security

  3. Front and back copies of Green Card

  4. Official Tax Transcripts of Joint Return for year 2010

  5. Official Tax Transcripts of Joint Return for year 2011

  6. Official Tax Transcripts of Joint Return for year 2012

  7. Copy of Federal Tax Return of Joint Return for year 2013

  8. Copies of Joint Bank Account Statements

  9. Letter from Veterans Affairs Dependent Confirmation

  10. 401k Beneficiary Confirmation

  11. Marriage Certificate

  12. Birth Certificate for son

  13. Copies of envelopes/cards addressed to both of us

  14. Family photos

This is what they are asking for by August 11:

1. Marriage Termination- My divorce is still pending and it won't be finalized by the date requested

2. Identity Document- copies of the conditional permanent resident and petitioning spouse's driver's licenses or identity cards from the appropriate state's dmv. So mine and my ex's driver's licenses right?

3. Evidence of good faith marriage-

ROC (Divorce Waiver)- CSC

2/14/14- Filed for Divorce

2/28/14- Sent I751 Packet (divorce pending)

3/3/14- NOA1 (receipt date)

3/5/14- Check Cashed & NOA1 Received in the Mail

3/6/14- GC Expired

3/11/14- Received Biometrics Appt. Letter (for 3/28)

3/21/14- Biometrics (done 1 week early)

5/20/14- RFE received for divorce decree/more evidence

8/8/14- Submitted further evidence, no divorce decree yet

9/12/14- I751 Denial received

10/8/14- Divorce finalized

10/14/14- Sent I751 Packet again, with divorce decree! (Refiling)

10/15/14- NOA1 (receipt date)

10/17/14- Check Cashed

11/03/14- Biometrics Done

3/6/14- 1 Year Extension Expired

3/24/15- I551 Stamp in Passport (1 year extension)

4/16/15- APPROVED! E-mail & Text Received

4/20/15- Approval Letter Received via Mail

4/25/15- GC in hand! Happy Birthday to me! :)

#1 - Are you filing too early and trying to use a divorce waiver which you can;t do if you aren't divorce yet?

When did you arrive in US and get green card?

#2 what ever pieces of identification you have, passport, drivers license, student ID card. Picture and identification they want to see

#3 This is a situation where you have to show evidence you entered the marriage in good faith. Not a good thing that you are already divorcing less than 2 years married. So they want to see evidence only you can go through the thing sand decide.

I don't know what I did, but I wasn't able to edit and finish my post.......

Evidence of good faith marriage: they are asking for copies of mortgage agreements or deeds/real estate titles, copies of insurance policies i.e. life, medical, vehicle, copies of credit card statements, copies of loan documents i.e. car, home improvement, business, copies of rental leases/agreements, copies of utility bills

During our marriage we didn't purchase a home or a car either together or separately, we lived with my parents therefore the lease and all utility bills were in my father's name. Due to his bad credit, we never took out a loan or had any credit cards. So aside from asking my father for a notarized letter explaining our situation, I'm not sure what else to submit, any advice is appreciated.

What you were missing was the sharing of residence. A lot of people had the same issues, one thing you can do is to have your parents write affidavits attesting to the time you guys lived in their house. Notarize the affidavits too.

gather what ever you can gather and get a notarized affidavit from your parent that you were living together with the dates.

if both of you agreed on divorce, then try to go to the court clerk, and explain your situation, sometime they expedite the divorce for immigration related issues,I know this happens in my county, I am not sure about yours. Consult with a divorce lawyer and see if there is a way to expedite it. also consult with experienced immigration lawyer to see,in case if the divorce paper delayed , what options you have

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received
