If one enters this country without inspection(no visa), it has violated the law! That person has only one thing to do: leave the country on his/her own, or face deportation. It cannot get marry to a US Citizen! This, as we all know, is not the case. There are 11 million people leaving in the US without legal status, working, studying, getting marry, etc, etc. Some even vote!

Now, if the person enter the country with visa, it has not violated any law, therefore, it can get marry to a US Citizen and apply to become a permanent resident. That is your case here.

The question is: what are you guys going to say in front of the Immigration Officer when ask: how did you guys meet?

We are so nice, we are doing it the right way. We are bringing our fiancées with the proper documentation , vaccination, etc, etc. I know my fiancée is not communist, terrorist, atheist, etc.

IF you are successful in entering the US, get married then fly back to Pinas.

Your husband can file i130 after your marriage. You stay put in the Philippines while the i130 is being processed. Waiting time could be more than a year (or even longer depending on the Visa Bulletin).

I believe you also got married to a permanent resident correct? Can you guide me through the steps please? :)

I am going to the US with a tourist visa. I dont plan on staying there after we get married coz i have work here in the Philippines. We will go through the waiting time. I have the following questions.

What is the first step we have to do for the petition after we get married?

Do we file the petition in the US while im still there or should we wait for me to get home? I'll be staying there for just 3 weeks.

If we are going to file the petition while im there, what documents do i need to bring?

Any other tips? :D

We're already engaged since december (went there to propose to her) and it I dont think it would be an issue if i just tell them that im going to visit my girlfriend. We've known each other ever since we were young since she lived here before migrating.

Yes, I know you will be entering legally the country, and that allows you to get marry here to a US Citizen and apply for permanent resident. You don’t need to leave the country. Just keep in mind the interview you will have .

Forms I-130, G325A for you and for your spouse. A copy of your marriage certificate.

Because you're not adjusting status in the US. You will go thru consular processing.

Number 1 for spouse. Letter D says we also need form G-325A?

And for letters E-J, any other documents that may be considered as evidence of marriage like Joint ownership or property, documentation showing co-mingling of financial resources, etc. Which of these did you pass? :)

We submitted the NSO BC of our children as additional evidence for the i130. For the co-mingling of financial resources, we didn't submit anything because we didn't have a joint bank account. However, during my embassy interview I brought money remittance receipts (hubby sends me monthly allowance) as back-up evidence.
