Hi everyone,

My stepson's interview is next Tuesday. I did not submit our marriage certificate because it isn't required, I was told by NVC people on several occasions. My mother-in-law received a call yesterday asking that we bring our marriage certificate to the interview. Thank God they asked for it in advance. My question is, are we (my husband or myself) required to attend the interview with our son since he's a minor or is it ok to have my mother-in-law or brother-in-law accompany him to the interview? Please, I'd appreciate a reply from those who have dealt with this so we can quickly book a flight to Jamaica, if we must.

Thank you

Oh, thank you so much for replying. I have been looking all over the internet for an answer. We would go with him, except we have to buy another ticket in July when school closes to go get him. My husband was given sole custody back in 2012, and we plan to send a copy of the court's ruling for my brother-in-law to take with him. I guess it would be a good idea to include pictures. They all look alike, my son, my husband, and my brother in law. I am hoping that would help. :-). Again, thank you!

The guardian can take the child to the interview, but I'd email that persons name to the consulate

kingstonivappointments@state.gov

Legal Guardian only. If father has been granted sole custody, there is no legal guardian. Father is the only one who can take him.

For children, a guardian or responsible adult may accompany the child if the parent is unavailable.

letter from parent would qualify OP

I replied based on what just occurred with friend, parent did not take children, and sister took them and they turned them away. However, for an immigration interview that may be the case as that was for a nonimmigrant visa when they got sent home. Since he has sole custody, and is oversees, ithey may allow that.

Thank you everyone for your replies.

Jawaree, the only problem with emailing to ask them is that the interview is Tuesday, and Monday is a holiday. So they are closed today (Friday) and Monday. I will not receive an answer before the interview.

Apple21, thank you for taking the time to look up and post that quote for me.

They called us yesterday to ask that we bring the marriage certificate to the interview. I went today to Fedex to mail the original, but I was told the earliest it would get there is Tuesday. :-( I hope a copy would be all right. I will definitely be sharing with you all the outcome of the interview Tuesday.

I am also petitioning my stepson and about to submit his documents for ds260. There would be no reason to submit my marriage certificate, right? Because the list of required docs pertains to the applicant. Is it that they want to see your marriage certificate because they are checking up on the i130 docs? Just trying to understand ! And best of luck Tuesday!!

Wendy, I have no idea why they asked for the marriage certificate since it isn't required for I130/IR2 case. I will find out in a hour or so how the interview went. I have decided not to stress about it any longer. My baby will be home soon by God's grace.

So my brother-in-law called. They kept our son's passport and gave him an address for us to mail the original marriage certificate. They told him that they don't have to go back for another appointment. When the receive they original marriage certificate, and after they have reviewed it, they will send it and the passport to DHL. I am so pissed off! I am yet to find a place where it says that original marriage certificate of the step-parent to the birth parent is required for an IR2 visa. And if they wanted it, why wait until the day before a holiday to ask for it! So the person who asked if they need the marriage certificate, I guess have an original one handy when you get to the embassy. Another thing I am confused about is that my brother-in-law stated that you are no longer required, at least in Kingston, to pay for DHL to deliver the package. The fee is now included in the amount sent to NVC? Has anyone heard this before? I am so disappointed. My husband's case took over 2 years. I just hope that our son will not miss the beginning of the school year here.

So annoyed!!!
