So I'm hoping to find someone who has experience of the situation I'm getting into.

I'm a British citizen (born there of British descent) married to a US citizen. We are currently living in the USA and are expecting our first child. The problem is that we are planning to relocate to the UK probably just after the baby is born. We are getting a UK visa for my husband but I'm trying to figure out how to get the baby into the UK and be able to get access to healthcare and things. Do I just get him a USA passport and take him to the UK on that? or Do I need to register the birth with the British embassy and get him a UK birth certificate as well as the USA one? or do I need to get a UK passport for him? I've searched online and found instructions on how to get these documents but I'm not sure what I will actually need.

UK Passport is easy option.

Visa for Spouse is now a bit complicated.

The baby can have a passport from both countries.

Have you already filed for your husband's visa?

If not, when is this baby due in relation to the planned visa filing?


Your baby is a UK citizen by descent. As Boiler said I imagine just getting a british passport would be the easiest route.

Are we sure? OP says she was born of descent in the UK. I presume she spent most of her formative years in the UK, and has since acquired full British citizenship...........................

We filed for my husband's visa a few weeks ago. We are waiting to get it back. We had the option of his new UK based employer filing a business visa or me getting him a spouse visa - spouse visa was the easiest, cheapest option so we went with that. We had hoped to move before the baby was born but it's looking unlikely. I know I could go back to the UK alone and him come later but we don't want to be apart and I need to be here to help pack everything up. We also put on his UK visa application that we would be entering the UK together.

So you have a job lined up in the UK earning £18600 or you have savings of more than £62500?

I'm not asking your personal business because I'm nosy. I'm asking because those are the requirements for grant of a spouse visa in the UK. Many people in your position would have chosen the employment visa...........

OP states they were born in Britain of British descent. I assume they mean their parents are british by birth and therefore they would be considered british by birth so baby is british by descent. Even if OP's parents weren't british by birth but OP was born in Britain before 1st January 1983 then OP is considered a full british citizen and baby is british by descent.
