I just got off the phone with the NVC and they said our case was on its way to Auckland, NZ.......but we filed for Suva, Fiji. What the heck!?

And we used a lawyer......I want my money back. Ha.

Any idea what I should do?? The NVC guy said maybe Auckland can send the case to Fiji. Ugggh!

My fiance is from Tonga (whose consulate is in Fiji) and his address he was at (visiting) was in Auckland at the time of the I-129F filing, but I am pretty sure it said Fiji on the application. He is in Tonga now....does it matter if he interviews at his home consulate in Fiji or in a neighboring country (NZ)? Should we try to have NZ send the case to Fiji?

-Which consulate did you put on I-129F?

- if you put correct consulate on your I-129F, and then you can ask the NVC sent to the listed consulate. There are many cases here on VJ that successful sent the case files to the correct consulates.

- This is not the first time someone complained their attorney. Regardless, sometimes the NVC was wrongly assigned a case number of case files and sent those to different consulate.

- He can do his interview according to his case number. I have friend here, instead changed the consulate, she chose had her interview to different consulate though her fiancé put another consulate on I-129F.

Oh, one thing I forgot to mention, you said that his current address when you filed I-129F was in Auckland. That was also happened to my friend. Her current address was in Jakarta, Indonesia, but her fiancé listed The US embassy in Manila as the place where she will attend her interview. The NVC sent the case file to Jakarta instead since her current address was listed in Jakarta, Indonesia.

Of course I reviewed what was sent, but the lawyer was the one who last touched it so who knows. I just checked the copy they sent to me of what they say they submitted and it definitely says Suva, Fiji.

Can the NVC send another copy of my case to Fiji or is there only one copy...which is now on its way to NZ? The NVC guy didn't quite know what to do...

Call the NVC again and tell them about you want your fiancé has the interview in Suva, Fiji. Only one hard copy of I-129F package ( the one that you filed at first time) even though they also have electronically copy of it.

And that is why it was sent to Auckland (see highlighted above), your lawyer entered this address on the I-129F on page two and NVC just looks at that address when they send the case file, NVC doesn't bother looking at page 5. Rookie mistake. Lawyer should have entered his HOME address where you planned to complete the visa application.

You and/or your fiance should also contact the embassy in Tonga to request this file be transferred.

I am for sure a rookie but you'd think an immigration lawyer wouldn't be......I'm so annoyed. :angry:

Thanks for your responses guys! I'm thinking of NOT using this lawyer (or any lawyer) for the paperwork for the interview. Not worth the $$, clearly.

Just follow the guide on VJ and you would be fine as long as you never had trouble with the US immigration before. My husband and I never used a lawyer though my husband had a thought about it but I highly refused it since I joined on VJ and got abundance advises and helpful thoughts from people who had been through this process before. My I-129F was approved in 38 days without RFE and visa in hand in 143 days ( including delayed the process due the hectic schedules of work from both of us). Edited by Girl from Celebes
