Hi everyone

I need some urgemt advice. My family and I arrived in America about 1 month ago to see my wifes family but her mother has been diagnosed with advanced MS and now my wife wants to stay to help look after her. I arrived on a Visa Waiver but, due to the nature of the situation, how can i go about changing my status?

We knew she wasn't well but not to this degree.

Can anyone forsee any problems if we were to try and alter my status? Obviously the last thing i want to do is leave my wife and kids in the States whilst i wait up to a year for the application to be processed.

Go for it. Start the AOS process and apply for Advance Parole so you can travel while the process is being adjudicated. Beware however that you will not be able to leave the US for at least 3-4 months, which means you will need to plan for quitting your job, your kids' school, closing your home, shipping your household and disconnecting with your life in Australia remotely.
