Can a spouse live in the USA while waiting for K3 Visa to be approved.

Or what if he doesn't? Then he no longer can use the VWP. They already know he has intent because of the I-130. It's a risk with possible long-term consequences.

The possibility is there. However, when anyone files the I-485 with the I-130 there is always intent from the way I look at it.

No, we're going to reluctantly do this the route we have started. :dead:

In the mean time, He is coming back for three months visits... We not bare to have our family split up into two countries. So we have to pay the price for not filing the I-485 with the I-130. Huge screw up on my part... :bonk:

His second three month visit to be with us starts June 24th 2014... Next month!

I'll be sure to let anyone else I know that is going through this process to not make the same mistakes we did.

I would be careful to avoid saying he was definitely coming for three months to the girls, if I were you. There is a possibility that they will feel that kids and a wife in the US is stronger ties to US than any ties he might have to Australia and he could get rejected. So I might not use that as a comfort point to your girls. When they're sad, I would probably say something like 'don't worry, we're working to make it so he won't have to leave again' rather than 'he's coming to visit at the end of June!'

Just so they don't get hurt if there are problems.

2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

Nothing is ever definite is it? We all are helpless hopefuls waiting on a glimpse of a reality that may or may not ever arrive.

Thank you for pointing out how this situation should be direct to the girls. I never thought of putting it that way to them. How you word things is key, especially to children. I'll keep that in mind when they're upset. Xx

No, nothing is ever certain. I'm supposed to be visiting my wife in the US at the end of June, but I've got to keep telling myself I might get rejected.

I used to be a nanny, so I know a couple things about kids and them wanting parents around. And if he does get to come (he should, I hope) I would make sure they are aware from the moment they see him that he's going to be going back to Australia for awhile. Possibly put it along the lines of 'He's going back to Australia to finish things up so he can come here and stay" or whatever would work for the girls.

Right now I just keep telling myself he's is over there for work. To try and keep myself sane but its a whole other ball game when the children get upset. (It surely hurts you when you see your own child in distress) .

I don't have kids and I know how stressed out this whole situation is making me. I can't imagine trying to navigate it with children in the equation, honestly. We've all chosen a tough row to hoe, but we'll get to the end eventually. I spend a lot of time telling my cat stories about what the US is going to be like, honestly. So I'm not entirely sure you could say I'm maintaining my sanity. But I'm trying.

For me, as the foreign spouse, I've got a possibility at a larger, better paid contract coming up at work (not sure yet) and I'm trying to decide if, if it gets offered to me, I should take it, since I don't know if I can commit to a year. I'm really hoping it'll be less time than that. And I know I have six months of leeway to enter after getting the visa, but do I really want to either a) break the contract or b) wait longer to be with my wife?

Borders are so stupid. I know why we have them, but I don't have to like their existence!

He has no intent what so ever. He will be returning the end of next month for a visit with us. He will be returning to Australia at the end of September.

I think I stress more then the children do at this point. They are happy to talk to him on Voxer (a smart phone App that is a walkie talkie and world wide and in real time) plus Skype and free calling through Facebook.
