I would also like to say when he got his approval the woman said "I am going to recommend to approve this petition". That means he's approved right? She did take his passport and said he will get it back in two weeks.

I was just told I was approved.

Why do they say it like that? Seems sort of silly.

Okay so I just did some research and found out that the VO does not make the final decision. They can only recommend to approve then its passed to someone else higher up. They are the ones who can truly approve it. So you aren't actually approved till you see Issued in your CEAC status. It explains why some people get their passports back in the mail with no visas.

Thanks for the positive response! I had my interview the same date as Corvusheart and was also told that they were going to 'recommend me for approval', started to doubt the approval but after reading other timelines and experiences on VJ it has put my mind at ease.

They can only ever recommend no matter how they say it. The VO is not god. The final decision is left to someone higher up. The woman we got asked only for supporting financial documents and not the affidavit of support do its possible we might get 221g.

From the U.S. Department of State Foreign Affairs Manual Procedural Notes

9 FAM 41.81 PN2 EVIDENCE OF SUPPORT

(CT:VISA-1823; 03-15-2012)

A K visa applicant and any accompanying children must meet the public charge requirement of INA 212(a)(4) (8 U.S.C. 1182) like any other visa applicant. Evidence of support is usually requested by the consular officer. There is, however, no absolute requirement that an affidavit of support or other public charge documentation be presented. It is only necessary that the consular officer be able to conclude that the alien is not likely to become a public charge. It would not be unusual, therefore, for a healthy alien of working age, applying alone, to be able to establish eligibility during the visa interview without the need for substantiating documentation.

9 FAM 41.81 NOTES

9 FAM 41.81 N4 DOCUMENTARY REQUIREMENTS

b. K-1 and K-3 applicants are subject to INA 212(a)(4) and must demonstrate to the consular officer's satisfaction that they will not become a public charge. The Form I-864, Affidavit of Support Under Section 213 A of the Act, cannot be required. Applicants may submit a letter from the petitioner's employer or evidence that they will be self-supporting. The Form I-134, Affidavit of Support, may be required when the consular officer deems it useful

9 FAM 41.111 AUTHORITY TO ISSUE VISA

Issuance outside the United States. Any consular officer is authorized to issue regular and official visas. Diplomatic visas may be issued only by:

(1) A consular officer attached to a U.S. diplomatic mission, if authorized to do so by the Chief of Mission; or

(2) A consular officer assigned to a consular office under the jurisdiction of a diplomatic mission, if so authorized by the Department or the Chief, Deputy Chief, or Counselor for Consular Affairs of that mission, or, if assigned to a consular post not under the jurisdiction of a diplomatic mission, by the principal officer of that post
