AOS Checklist- letter of employment salary is different from annual income. Will I get 2nd checklist?

Some info: I am an aide/tutor for a student with special needs and I am paid by a couple. When I did my taxes at H&R Block, they put me down as self-employed, so when I filled out I-864 I put myself as self-employed and thinking that I don't work for a company, I didn't send a letter of employment. (Ugh, I know, I should have!)

Of course- I got a checklist 2 weeks ago asking for a letter of employment, so I called NVC and they said the mother of the child I aide/tutor could write a letter for me stating my salary, no problem.

My question is:

When I sent out my AOS packet in mid April, I put down what I made for 2013 as my current annual income as well, because I have been working the same schedule that I did in 2013. Well, since sending out the packet, my schedule has changed- I started working more, so I've started making a little more money. When I originally filled out the form, my income was somewhere around $10,000, but my letter of employment states $13,500. My "boss" calculated what I will now be making this year. Does anyone know if I will I get a second checklist now because my letter of employment doesn't match my income? I know this is a weird situation and yes I have a joint-sponsor.

I don't want our process to be pushed back again. :(!

If the amount does not match the amount on your i-864 form they will push it back to you. It would be better if you just filled out a new i-864 to send along with your letter of employment. Make sure that your occupation matches what is in the letter of employment as well. For example your letter could state you work as a special needs aide but in your i-864 you write employment as a tutor. They will not link those 2 things and push it back to you.

I wouldn't fill out another form. If you are making more this year then just have the woman write a new letter stating last year you worked such and such amount of hours and was paid XYZ and this year she has you working more hours (amount of hours) which will continue and you are now making more money. I don't see it being a problem if someone is making more than what they claimed for last year taxes. People get raises all the time or pick up more hours.

But as the other person stated if the employment job description doesn't match that might raise a flag and you would be better off just filling out a new form. I'm not an expert but I'd rather have all my ducks in a row not to get another RFE. Good lukc

If the petitioner indicates that they are working they still have to prove it. Just because they don't make enough to sponsor on their own doesn't mean they are exempt from proving their own situation.

Yeah, the only reason I didn't send one off in the first place was because the form i-864 instructions said, "You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer..." I should have called NVC in the first place and asked if a letter from the mother of the child I work with was sufficient, I just wasn't thinking. :oops:
