HELLO GOOD PEOPLE OF VJ.IM A NEWBIE SO PLEASE BE PATIENT WITH MY QUESTIONS AND PROVIDE OPINIONS IF YOU HAVE ANY.THE UTTER ARROGANCE OF SOME CONSULAR OFFICERS IS SCARY AND THATS WHY IM ASKING THE QUESTIONS.I MET MY WIFE IN BOGOTA IN LATE FEB.2006.OBVIOUSLY THERE WAS INTEREST IN BOTH OF US.I WAS THERE FOR TWO WEEKS AND RETURNED HOME TO FL.AFTER A FEW WEKS SHE WANTED TO COME TO THE US WITH A TOURIST VISA TO KNOW THE USA AND TO KNOW ME BETTER.AS IS NORMAL IN MOSTS POSTS SHE WAS DENIED.IN A FEW MORE WEEKS SHE HAD AN INVITATION FROM HER BOSS TO COME TO MIAMI ON BUSINESS.AGAIN DENIED.SO I DECIDED TO RETURN TO BOGOTA TO KNOW HER BETTER.I SPENT TWO MONTHS THERE AND WE REALLY FELL IN LOVE.BECAUSE OF HER DAUGHTER 18TH BIRTHDAY IN OCT.WE THOUGHT IT PRUDENT TO GET MARRIED BEFORE THAT DATE.WE WENT TO SAN ANDRES IN SEPT.AND GOT MARRIED.I THEN RETURNED HOME AND STARTED THE K/3 PROCESS.WE HAVE QUITE A BIT OF EVEDIENCE SUPPORTING OUR RELATIONSHIP ALBEIT BEING SHORT.JUST AN OPINION ON WHETHER HER APPLICATIONS FOR A TOURIST VISA WOULD INITIATE SUSPICION OF FRAUD INTENT AND IF THE CONSULAR OFFICER WILL EVEN LOOK AT THE EVIDENCE WE HAVE WHICH IS CONSIDERABLE AND SHOULD BE CONVINCING THAT IT IS A LEGIT RELATIONSHIP. Just an opinion here but I would think that the reasons for her being denied a visa on 2 prior attempts would be of a more significant concern that the duration of your relationship.

This is definitely one of those situations that warrants a visit to an immigration attorney.

Well, for my experience, or my husbands experience... he had applied for a student visa in 2005, he was denied that one. Then we got married in 2006, they sent the K-3 back to the USA for validation of our relationship/marriage. Still waiting and its a long process. Hs interview for the k-3 was in 11/2006. We had lots of evidence as well. The officer did NOT look at the evidence my husband had. She made a comment about the student visa, (which at that point about 1 year ago)nd she said she thought our marriage was arranged so that he can come here. I was insulted, ( I wasn't there though), confused, hurt, embarrassed, anything you can think of, we felt it. Now we have to "prove" that our marriage is legit. I dont know how they may want us to do that. It's 2 months later, and I am still waiting to find out "where" my husbands case is. Is it already here or is it still there, what info are they requesting from us now?

Its gonna be hard if they refuse to issue it at that time. According tothe info I habve gotten from here. It wasn't denied, they just want more information. Whatever that means.

I would be very cautious about the previous attempts to come here. They can bite you on the rumpkus!!!!!!!!

THE DENIALS HAD NOTHING TO DO WITH MEETING ME BEFORE SHE APPLIED BUT WAS DUE TO LACK OF STRONG CONNECTIONS TO RETURN EVEN THOUGH HER DAUGHTERS WERE THERE AND SHE ALSO OWNS HER APARTMENT AND A GOOD JOB AND FUNDS IN THE BANK.TO GET A TOURIST VISA FROM BOGOTA IS EXTREMELY DIFFICULT IT SEEMS.

Why are you inclined to make a corrolation that a denial for a tourist visa could lead to a finding of fraud? Lack of sufficient ties to homeland is a common basis for a denial. Cnce the K-3 is submitted, you're pursuing the correct path.

You can pick up an atty at pretty much any point in the process. Some people try this on their own and then retain an atty if they have problems. Sounds like you might want to at least consult with one. My fiance was going to try to come here on a tourist visa for the same reasons as yours, but I was advised not to have him do it, because it would most likely be denied and make things harder later. my spouse was denied a visitors visa in june 2006 and they knew we were engaged at that point. The consular officer asked her about the denial at her K3 interview, but then said it doen not matter anyway for this type of visa. I was there next to her flaunting my US citizenship to the consular officer. I am almost certain that if i were not there, they mayhave given he a very hard time and possibly even deny her. Who knows though?

ANyway, I am glad that i was there and recommend anyone with doubts about their case to have their spouse present at any interview, if possible.

Well, for my experience, or my husbands experience... he had applied for a student visa in 2005, he was denied that one. Then we got married in 2006, they sent the K-3 back to the USA for validation of our relationship/marriage. Still waiting and its a long process. Hs interview for the k-3 was in 11/2006. We had lots of evidence as well. The officer did NOT look at the evidence my husband had. She made a comment about the student visa, (which at that point about 1 year ago)nd she said she thought our marriage was arranged so that he can come here. I was insulted, ( I wasn't there though), confused, hurt, embarrassed, anything you can think of, we felt it. Now we have to "prove" that our marriage is legit. I dont know how they may want us to do that. It's 2 months later, and I am still waiting to find out "where" my husbands case is. Is it already here or is it still there, what info are they requesting from us now?

Its gonna be hard if they refuse to issue it at that time. According tothe info I habve gotten from here. It wasn't denied, they just want more information. Whatever that means.

I would be very cautious about the previous attempts to come here. They can bite you on the rumpkus!!!!!!!!

Just an opinion here but I would think that the reasons for her being denied a visa on 2 prior attempts would be of a more significant concern that the duration of your relationship.

This is definitely one of those situations that warrants a visit to an immigration attorney.

This is what really worries me, I'm a uk citizen and i applied for a b1/b2 visa ( as advised by the embassy) so that everytime i went to visit my finace in the US i wouldn't get hassle or sent back at the POA, i was denied my b1/b2 visa in 2006, we are now married in 2007 and really really REALLY hope that because i was denied that visa they won't hold any grudges as to the previous denial of a b visa. When i spoke to the consular officer he told me that it would not be brought up. But seems here that it could get brought up at the interview. I've been saving as much evidence as possible to show that i'm not just trying to immigrate to the US, but how does one make a consular officer belive you married to be with your new family.... I really wish i never applied for the b visa in the first place, but was advised to by the embassy, now i can't

going through HELL

Maybe getting denied by a U.S. embassy in some "first world" county would be a negative, I can't imagine that being denied by the U.S. embassy in Bogota will be a big deal. As you've learned, the U.S. government denies many, many Colombians every day. In fact, from what I have been told, Colombia is one of the hardest countries from which to get a tourist visa to the U.S. As the U.S. Department of State says, the presumption is that the person is coming to the U.S. with the intention to stay...unless he or she can prove otherwise.

My wife tried to get a tourist visa for herself and her daughter two years ago to visit Disney World and was denied. If that is raised at her interview on Friday, I will let you know. But I have not worried about it.

Honestly, I don't think you need an attorney...unless she gets denied. Not much you can do at this point. Just tell her to answer any questions at the interview honestly.

8/28/07 - Re-scheduled (from 6/28) AOS interview in Orlando - AOS approved.

11/18/09 - Removal of Conditions approved
