How can you proof a consular wrong for age difference between spouse accusation during an Interview?

You mean how can you convince a CO that your relationship is genuine and bona fide despite the age difference.

Lots of face time being together and involvement with family.

Showing your hopefully long and often visits.

If she is beyond child bearing age ask yourselves if it is an option to adopt a child here ? Have you both discussed it ?

If yes then bring that into the mix when or if appropriate, don't cram it down the CO.

Have her physically there waiting outside during the interview and hand over her passport and tell the CO she is outside and would like to

speak to you if necessary.

There is no magic answer, it has to spring from inside of you and be authentic and not a part you play with mere words you say.

CO's sensing is quiet high no matter what you say, often they are right but many times they get it wrong too.

Being genuine on a natural and personal level and honestly speaking from your heart is important,

not proving the CO wrong in a Q&A drill session.

No, front-loading evidence with the petition, means the C.O. is required to consider it, because it is presumed USCIS did in making their petition approval decision. The C.O. is NOT REQUIRED to consider or even look at any evidence submitted AFTER the petition, but they usually will, unless they have already decided firmly to deny.

So you mean the front loaded paperworks itself can confuse the CO? Or the paperworks come the Interviewing country with a notice? Some feels like they already know whom to grant visas, whom to put on AP and whom to deny.

Front loaded evidence will not 'confuse' the CO unless you mean 'influence'. It would be confusing only if the evidence itself

is confusing, doubtful or suspicious. (Fillers, over loaded, large time gaps).

If the evidence is not submitted from the start at USCIS, they (Lagos) often will make up their minds before the interview, yes that is correct.

If they see good quality evidence reflecting a genuine flow of relationship before the interview then of course that is a good thing.

One thing I often hear is not to send in too much because they will take their questions from the material you submitted.....

well, if it is genuine then there is nothing to worry about because you will be familiar with it already, what is there to be confused about ?

your question stems solely at the interview. Let's back up a bit, aye?

if you did not present the evidence mentioned in the I-130 instructions, the 6 types listed there, you have another chance to submit it during NVC intake on the civil docs.

But - even with that said - if you are making stuff up, submitting things that are false, a Vice-Consul will smell it, as

the entire casefile is reviewed prior to interview day - a Vice-Consul has about 20 days from the time the casefile hits the IV unit to actual interview day.

So if your evidence is stellar, and it seems to flow in a natural way, then it's useful to submit it. If it is fabricated, a Vice-Consul will know it, and apply a cultural norm to your interview process and seek to deny you.

If there was no evidence submitted, then of course the Vice-Consul will ask you lots of questions about this age gap - evidence you should have submitted during the I-130 phase would have overcome that red flag and you two failed to include it.

So, regardless of your initial question - it begs another question - what evidence was already submitted, and what do you feel, from that pile, would overcome the red flag of the age gap?

and - because of your initial question - I must ask - what has lead you to believe that a Vice-Consul would accept any evidence on interview day in Lagos, Nigeria ?

we did submit a box of evidence at the first stage with USCIS and now at nvc, how will the consular be aware about the evidence submitted at USCIS stage

it all travels with the casefile,

from USCIS to NVC to Lagos,

and is viewable by any Vice-Consul, for about 20 days, prior to the interview.

Sending too much means you can be certain they will not read it all, and that you'll never know or have any influence on which portions, if any, of what you sent, actually gets seen or read. Sending a reasonable and well planned amount of evidence with the petition provides assurance they'll see what you want them to see AND consider it.

I agree. By 'fillers' and over load I was also addressing the submitting of tons of papers that contain more than one

copy of the same thing to make it appear bulkier to impress the CO and to send other meaningless or altered items.

They will not be impressed !

Striking a correct balance depends on the length of the relationship as well. One has more communication in 4 years

than in 6 months.

Overloading is a fraud indicator and not submitting enough is foolish.

Being refused for discretionary lack of bona fide and having a case returned which results in re filing demands more evidence than

a first filing, even if a reasonable amount was submitted the first time. The relationship evidence still needs to show a flow of samples from

beginning to current so it will automatically be more.

Well rounded and well thought out quality evidence is the key.

My fiance is from Pakistan, another high fraud country. We are 17 years apart in age. He had his interview less than a month ago and had his visa issued 3 days later. He was never asked about our age difference. Age should not matter if your relationship is real and you are truthful at the interview about everything. Of course nothing in this process is for certain, just wanted to let you know there are others out here with large age gaps that are getting approved....even in high fraud countries. Good luck!

How big was the age difference with the first fiance that tried to petition you? They are going to be very suspicious especially since you had never met your first fiance in person, and now you are trying again with an older woman.

Immigration officers are part of Department of Homeland Security (USCIS); consular officers are part of the Department of State. They don't use the same database -- that's one of the reasons the transfer from the service centers to NVC can take a few days. They have access to some of the same information -- things that are scanned into the official case file usually, but not necessarily all of the other things you submitted.

USCIS scans it all and forwards it via NVC to the consulate.

Where do you get that not everything is scanned ? They don't just decide not to scan half a petition.

They have access to everything about you if they want to check you in depth.

They may even know the color of your underwear
