Hello again visa journey. It sure has been a while. Never thought I would come back here but I am. My ex-wife and I were at the final stages of the NVC when a situation unfolded and we got divorced. I cancelled and ended the process thru the NVC and USCIS and everything was good. I thought the situation was done until...

I received a letter on May 7, 2014 from the Atlanta local field office director, Paul Onyango, stating that my case was closed and the previous decision was revoked. They even stated that it was the same date I had ended the process, September 27, 2013. I was cool with everything about the letter until May 9, 2014 I received a I-797C notice of action letter stating that they were treating the case as reopened. I read on the previous letter that you cannot appeal a decision but you may file a I-128B (I think, the letter is not infront of me) to reopen the case. The 797C stated that they would send me a notice later with a decision.

This is all awkward and confusing because I did not file anything and have not touched anything immigration related for my ex or anyone for that matter since September. I called USCIS customer service center yesterday...finally got to a tier 2 immigration officer and she stated she didnt see where the case was closed. She told me to go up to the Atlanta field office where the first letter was from and to show them what was going on to cancel it. I made the appointment for June 2. Hoping everything will be done and over. My question is...

Do you think my ex may have tried to reopen her case without me? Would this potentially be a touch by the USCIS and they want to reopen it? I am completely confused as to what may be going on. Anyone ever experienced this before? Any input is greatly appreciated!

08/13/2012: I-130 sent to Chicago Lockbox from Jordan (Nahda Office)

08/21/2012: NOA1

8/21/2012 : NOA1 Hardcopy

8/28/2012 : 1-797C Action Transferred to NBC (Assuming sent to Atlanta Local office...but no telling)

O9/4/2012 : Last touched.

2/26/2013 : Infopass with Atlanta (confirmed file is there and no action yet. To be started in March)

03/18/2013 : 2nd Infopass (No review or processing of any stand-alone I-130s for 60-90 days. URGHHHHHHHHHH)

04/6/2013: NOA2 (228 days from NOA1)

NVC

05/10/13 USCIS Atlanta letter to me confirms this date as sent to NVC

05/20/13 NVC Received Case (Waiting on case number)
06/7/2013 NVC case number assinged
06/7/2013 Choice of agent complete now awaiting fees

Gave up tracking when I left overseas...but we are almost done biggrin.png!

Do you think my ex may have tried to reopen her case without me? Would this potentially be a touch by the USCIS and they want to reopen it? I am completely confused as to what may be going on. Anyone ever experienced this before? Any input is greatly appreciated!

That is the most likely scenario, yes. You can clear it all up June 2nd.

I say bring in a letter to withdraw the I-864 on that interview day,

talk with the floor supervisor (only)

and

get the I-864 formally withdrawn, not leave the building till you have a formal letter of withdrawal, signed by a USCIS staffer, in yer hand.

as to what might have happened - dunno - Atlanta is a screwy office...

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Okay cool. Thats what I plan on doing. Plan on bringing all the email between the USCIS and NVC and I and the letters they sent me. I plan not to leave until I get an official letter stating that this case is completely closed. Thanks Darnell. Hope everything is going well with you!

ya - withdrawing the I-864, affadavit of support,

is the thing that kills any visa application process.

as to me and my wife - we're well - she immigrated in Feb, we've had a coupla hiccups but we're fine....
