K1 Visa Rejection....

My atty said he's NEVER had a K1 get kicked back for such a petty request..He said it's The TSC that's the problem...we sent sooo much add'l info with our app..I asked Jethro, How can I give you a wedding Date Numnuts when I don't know when the K1's getting issued!!!..Ok, we're getting married July 4th..Better hurry up guys.!!..lol..this entire process is a joke..It's very clear they are dragging these apps on purpose...They are so overloaded and If you've ever been at a DMV office or ANY Gov't office, did you ever see the speed at which these people work? they need to be Dusted off....

Yeah, and attorneys NEVER lie.....hahahaha That's the funniest thing I have read wll day for sure!! Thanks, I needed a good laugh. Made my day.

I jokingly suggested that she come across the border like many illegally entering the country as it would be easier and quicker. She looked at the map of Texas and said with a straight face, Net (Russian for No)..I cannot swim. :o I laughed and said "That's my girl"....so I will see you in a couple of years......Crickets

I do not mean to take away from the seriousness of the OP's dilemma. I have to scratch my head as well....if all documentation, including letters of intent, were submitted, then how can they ask when the wedding is scheduled? How the heck can he know? Maybe they are just saying in a very polite way that they believe Congo is a high fraud country and they want a little more proof? No clue. Hang in there OP and give them what they want.

I wanted to chime in and let everyone know what type of people are working at these places processing our petitions. I've been looking for work and had applied for an open position in VA that processes these claims- Texas sends some of them to other locations just an FYI.

They only pay these people 14.88 an hour and do not require any background education but a HS diploma. So we are probably dealing with teenagers or early 20 year olds who will work for such pay.. I've worked in an enviroment like this before when I was 18 and all we did was good off at work..

It's horrible these people have our lives in their hands and as for an alternative.. I am out of luck in that dept because my Fiancee is Cuban and it's practically impossible to get them OUT of Cuban to begin with. He was already denied a visitor visa this year.

All I can say is keep calm and send them what they want.. A k-1 can take a year it all depends on what you provided in the original packet.

I don't think $14.88 is horribly low. But not requiring a background check is a big no no. & it's sad that these young people do have others' lives in their hands but don't care.

wait..haha..I just started the process?? 6 months ago?? No..if they think I'm waiting a year for a K1 Visa, they're outta their minds..remember one thing..There's always more than one way to skin a cat...

Yes, you just started the process. K-1 is step 1. Then there's AOS, then ROC, and US Citizenship. So yes, even 6 months in, you are just starting the process. Relax before you burn yourself out or get na ulcer. Somethings are just out of your hands.

As for your threat (or whatever that was) regarding the wait.... there's nothing you can do to speed it up. If it takes a year to get the K-1, well then you're going to have to wait a year. If it takes a year and a half, you will wait that long. That's just the way it is. In this case, this is the only way to skin this cat.

we recieved two noticed for additional information one they wanted a original copy of the divorce we just copied the one from the court and wanted some more information on something else slowed us down about 6 weeks but hey its all sent in and approved,

Take responsibility for you & your attorney's actions. You or your attorney forgot to send signed letters of intent by you & your Fiancee. That is why you got an RFE. I know you're just venting. But you would have a better appearance if you'd say "it sucks that I didn't know I was supposed to send those or me or my attorney forgot to send them. As a result, I got an RFE" instead of saying everything you've said.

I hope this is nothing new. I've never heard of an RFE for the specific wedding date. Such an RFE would make 0 sense considering the smart ones don't set a date until after they receive the Visa.

I hope this is nothing new. I've never heard of an RFE for the specific wedding date. Such an RFE would make 0 sense considering the smart ones don't set a date until after they receive the Visa.

Yeah there is information missing here for sure. It just doesn't make sense that they would be told to provide the intended date of the wedding. And an RFE is not a rejection. My bet is his attorney is a lying sack of s*^^ and they neglected to include the intent to marry letters.

He may have said that later on - but he didn't say it in the comments of his initial post. He said it was "kicked back" "for more information".

I have a feeling his lawyer must have left out the part in the letters of intent - stating they plan to marry within 90 days of fiance's arrival. If that's what it is, he should be seriously pissed at his lawyer! Because most of us knew to put that in just from reading documents on VisaJourney.

Hiring a lawyer just to fill out forms (when there is no technical legal issue) is about the most absurd thing you can do in this case. Do it yourself. No one cares about it the way you do and no one will handle it with as much care as you will. Especially not lawyers. I would actually demand a refund from the lawyer if this is the case. Because leaving that out shows he shouldn't be handling these petitions as it's one of the most basic and important parts of the petition. Sounds like the lawyer is learning on the job - at his clients' expense.

Exactly. It is not a K-1 visa denial. His fiancee has not even filed for a K-1 visa yet. It is not even an I-129F petition denial. It is an RFE for the I-129F petition.
