Married 3 years or 3 years-90 days to file N400 ?

So I know I have to PR for 3 years - 90 days to file N400. If I file on that 3 years - 90 days date, do I have to be married for 3 years on the day of filing or can it be 3 years - 90 days ?

I got my GC in less than 3 months from the date of the wedding which is really why I have little problem described above - not that much difference (~17 days) but was just curious if anybody knows the answer...

All eligibility worksheets says you have to be PR for 3 years and married for 3 years but allow you to file 90 days before your 3 year residency anniversary...

You must be married a full three years before you apply.

You can only go 90 days early on the LPR part.

That is not true. To go under the 3-year rule, there are a number of eligibility requirements, and one is to have been married for a full three years before applying.

For most people, this "tick" doesn't matter, because they get their GCs over 3 months after they got married, but for the OP it does, since s/he got the GC very quick.

I have the same situation as you.

I was married April 2, 2011 and got my green card June 17, 2011

My eligibility for naturalization was March 19, 2014 (thats the 90 day window) but I would not have been married for 3 years then, so I waited to send it until my 3 year anniversary date (April 2, 2014) so that I would have met both requirements.

I would advise you to do the same.

Congratulations, you're the only one that misunderstood my question ;-)

It apparently is also based on date of marriage as I can be within 90 days window of 3 years of residency and not be married for 3 years.

Good you guys brought this up as we're exactly in the same situation and I was not even thinking of this that deep. Somehow just thought 3 years from GC issued...and good you guys pointed this out as we would've the same way submitted then "early" compared to the 3 yrs of being married. Phew! My husband became PR: 4/15/2006

Petition us (Me and two kids) and became PR: 7/11/2010

Husband apply US Citizenship: 8/1/2011

Received Application by USCIS: 8/3/2011

Biometrics Appt: 9/6/2011

Interview date: 10/25/2011

OATHTAKING: 10/25/2011

Husband became US CITIZEN: 10/25/2011

Based from these facts, when can I apply for citizenship? And when is the 3-years 90 days to file N400?

• Have been living in marital union with the U.S. citizen spouse, who has been a U.S. citizen during all of such period, during the 3 years immediately preceding the date of filing the application and up until examination on the application
• Be a permanent resident (green card holder) for at least 3 years immediately preceding the date of filing

Hi, Answer to your question and this might be late reply for you, but you became eligible to apply on 10/25/2014 and all your conditions met at that time. You cannot have applied on 07/27/2014 which is 90 days early as your 3 year marriage to US citizen (requirement A) would not have met. and early filing is only exemption for 3 year Permanent Residency.
