Hi, my wife got approved for her green card in Februaury but they mispelled her name. I let USCIS know and they had me send her card back to Arizona so that they could look at the case. I also included a letter with instructions and notifying them as to what had happened (USCIS rep told me to do this step over the phone). I also asked them to expedite the case since it was their error. I got a letter saying that they received it on March 31 and would look at it. I enquired on the progress a month later and they emailed me saying that they recognize the case is serious but they are backed up and wont expedite the case. I contacted our Senator and they said that they would look at it and ask for an update. That was 3 weeks ago and USCIS has not yet responded. It is my understanding that it is a 6 month wait if it is not expedited. We want very much to get this over with, she has waited for an extremely long time. Is there any advice that anyone could offer in this situation? Can we do anything to speed up the process? Again it was their error so I expected an expedite. Flustered.

Thanks

I doubt you'll be getting an expedite; "wanting it to be over with" isn't a valid reason to take someone else's position in the queue ahead of you for yourself, even with it being their mistake.

As stated, obtain an I-551 stamp in the passport and that will serve as temporary proof of a green card usually for around six months. If you've not received the replacement green card in six months, go and get another stamp.

My wife got her second 551 stamp last month. The first USCIS officer said it takes 6 months for a replacement card. Well, after 6 months, we made our second InfoPass appointment and got a 9 month stamp. We were told that due to a backlog, it is taking 9-12 months to issue a replacement card. We file for ROC in October so we may not have it by then because we sent the old one back in October 2013. And we used the 551 stamp for our second time yesterday at POE. I have nothing but contempt for the CBP and the way they treat most people in secondary. After sitting there for an hour listening to the two girls talk about their weekend, they were ready to deny my wife entry because in the hour they she had been looking at my wife's passport she never turned the page and was only looking at the canceled 551. Needless to say, it was a little unnerving after watching two other ladies escorted out in handcuffs. I don't know what they look at on the computers but it didn't help. After I realized they were looking at the wrong stamp (turn the page!) I finally had to tell them they were looking at the wrong stamp and our hour and half adventure was over and we were allowed on our way. In January we were interviewed by 3 different CBP agents as why my wife had a 551 stamp when it was written in her passport that the LPR card was returned per I-90 due to USCIS error. And I had copies of the GC, I-90 application, I-90 797, marriage certificate etc. In her "interview" yesterday they asked her parent's names, her high school, where I worked and on and on, it was longer than our AOS interview! We will not be traveling outside of the US again until we get the GC replacement or ten year. Not worth it to have someone potentially deny entry because they can't turn a page! And thank god that naturalization is only a year and half away! Ok, rant off.
