not willing this to happen, but just making sure if situation comes in future

I am married since 2 years, got conditional GC last march 2013.

as almost all marriage has little clash/arguments, we did too.

now because i have conditional GC, girl's parents at some point hinted that US has all laws in favor of girls, and i'll be in trouble.

I am trying my 200% to resolve the issue, and take her back with me. but as of now, she's at her parents.

I have not even thought about any of this situation till they mentioned this. I still have joint account, lease, car insurance, health insurance, together. and planning to keep that way.

now god forbids something happens, what are my chances of getting the condition removed from my Conditional GC.

I was on H1-B before,

I apologize if I missed any required information, but please help me with some information.

My personal thought, I want to be together. I will try everything to keep it that way.

You can remove the conditions on the green card with a divorce waiver (if it comes to that), or apply as a married couple if you fix the issues you're experiencing.

Provided you aren't abusing your wife, and you can prove that you entered the marriage in good faith (read the forms to see what evidence is required) you shouldn't experience any difficulty removing conditions on your own.

What if we r not divorced (or in the process of divorce) by the time i have to file my removal of condition, or not living together.

because divorce waiver will be there only after divorce right?

If the marriage has dissolved and you are no longer together, you will need to wait until your divorce is final and file for removal of conditions then.

yes i understand that.

but will I be able to stay in USA till the time everything gets final? without divorce, with separation?

You have an either or situation looming here. Either you remained married and file for ROC as a married couple during the 90 day window before your conditional GC expires OR you get divorced and file for ROC as soon as the divorce is finalized. Now should you file for divorce and it is not finalized before the 90 day window ends, you need to file the ROC with the divorce waiver and then will get an RFE for the final divorce decree which you send along when the divorce is finalized. Either way you remain in the US.

Good luck,

Dave
