Hi everyone - I have a question I hope someone will know the answer to.

I am on H1B and my first three years expires in Sep 2014. I also filed for AOs based on marriage to a US citizen last month. I received my NOA1s and just completed my walk in biometrics.

I found out yesterday that my company went ahead and filed for my H1B extension, and looking at the copy of the filing I see that they used a different A-number than what is on my receipt notices for the family based AOS. The A-number they used was what was on my original H1B petition too. However, I was assigned a new A-number after filing for AOS. I know that my EAD or GC will probably be here before September, so the H1B is not a big deal at this point. Still, will my company have problems with USCIS because they used the old A-number? Should I let them know or just let it be for now?

If you are talking about the number on the EAD it's not a "A" number, it does not count as one for filing forms, at least that is what my lawyer said when I tried to use it as such when I had a EAD (spouse of a L1-b visa holder). I did not get a A number until I filed for AOS

I got one A# when I had my OPT EAD, then tried to file my AOS from H1B with the same number. Even though I sent everything in for the I-130/I-485 with the original A# (I wanted to keep it for simplicity), they assigned me another one. It's normal, USCIS is aware that they do this, and shouldn't be an issue for your company or you.

The number on the EAD actually is an A# (alien number), but USCIS usually gives people new ones when they file for AOS. I asked my lawyer if I could keep mine and she said I could try, but they'd probably assign me a new one because they see it as completely separate from previous employment authorizations that were not associated with permanent residency.

Your company will not have a problem. For some reason, we (those who get one way or the other an EAD that is not via AOS to USC) all get an A# and yes, that is different from the one we get from AOS procedure. Do not worry, USCIS knows what they are doing. That A# is only working for your H1B process, while your "new" A# is for your AOS procedure. Just makes sure when you're filling out the EAD document and it asks if you have ever applied/granted EAD before that you say "yes" and make a photo copy of your EAD from your employment. Or at least, that's what we did. We had no RFE, and we got the whole AOS done literally in two months from the day of mailing in the package. All the best!
