Hi,

My wife and daughter, 13, submitted their I-751 at the first of May. My wife has received the NOA, which listed the $675 dollar accepted amount. However, it did not list my daughters name in any place. After reading this forum, I found several older posts. It appears that minor children under 14 do not have to do the biometrics, despite them taking another $85, nor does the child get a NOA. It sounds like my daughter will get her 10 year green card after my wife gets hers. Is this still current information? If it matters, they both applied and were granted green cards. Any help with this is greatly appreciated. Thank you.

Hey Brandon I was worried about this also. We also filed for Vermont. My wife got her i751 extension notice and about a week later another letter came for my stepson. Although I heard it it not uncommon to receive any letter for the minor. Hopefully you get both if nothing more than peace of mind.

It would be nice to know, if for no other reason than to know. Also, I don't have a lot of faith in the USCIS employees actually being accurate with their work. They lost both of my daughters health exams and we had to go get another one here.

Even though we submitted one I-751 with my step child listed, they send us a biometric appointment for her in a separate envelope with a different date for her appointment. But during our AOS stage, they misplaced my I-130 for her and we received a rejection notice. Fortunately, we submitted a copy of this form, so she received her conditional green card 46 days after my wife.

If this was 90 days or more, would have had to file a separate I-751 for her, this has happened to other people on this board. Managed to convince our field office to take her at the same time as my wife to save another 450 mile trip. Kids need that ten year card just like their parent. And if anything goes wrong with the marriage and the spouse is deported, so are the children. This is how the USCIS works.

Just saying if the USCIS misplaces one of your forms, you pay the price, regardless. And due to USCIS delays, she barely turned 18 when it was time for US citizenship, no ifs, ands, or buts, about the cause, she had to wait another two years.

How about a stepson that barely turned 21 at the time of the AOS, I could not petition for him, gather keeping a family together is not part of the USCIS.

We the common people can get along just fine with other people in this world. But if our leaders can't get along, have to pay a very stiff price for this.

My daughter came in the same time as my wife and also received her green card 30 days after my wife. We still have not received a NOA for my daughter, but we also have not received a biometrics date for my wife either. However, it sounds like your children are all over 14, which from what I understand, they have to do the biometrics. My daughter is 13. And calling the USCIS, is useless. Apparently, they don't have an option to talk to a person anymore. I hear its because they are over loaded.

I finally got through to a USCIS representative. This is what I was told. Because she is under 14, she will not receive a NOA and may or may not have to do the biometrics. If she does have to do the biometrics, she will get a notice. If she does, it will be to get a current photo and signature. Of course, the bad part is that she will turn 14 before they get their 10 year green card, so I am curious how that will play into this.

That would be odd if by the time the decision making rolls around they'll deny her saying she skipped biometrics at the time (since she'll be 14 by the "decision making" time). It is sad that USCIS decision on whether to do biometrics, or losing/keeping forms etc. is diverse. It's like you bought something at Wallmart at X location and you would not be able to return it at Wallmart at Y location. It's the same company. Similary, USCIS is "ONE entity" and show do everything uniformly...apparently not....

I must admit, I will be glad once this is done. My wife can then take her citizenship test once the 3 years are up and we will be done with this convoluted process. Thank you everyone for your replies.

Why doesn't it surprise me that what they say and what actually happens is different. With that said, it appears to be whoever is reviewing the file that day whether a NOA and biometrics is sent. It should be consistent, but it simply is not.
