Question No. 2. Have you received public assistance in the United States from any source, including U.S. Government or any State, county, city of municipality (other than emergency medical treatment), or are you likely to receive public assistance in the future?

Answer : Yes.

Explanation :

I answered YES to the part referring to having received public assistance in the U.S., I did apply for WIC assistance in 2006 until 2007 for my US citizen son XXXX XXXXXXX due economic hardship. I had previously applied for Employment Authorization while having the status of F-1 visa holder and the application was denied. I had been divorced for a few months, I did not have family nearby to help me, I was living in a friend’s house during the first part of year 2006 and at the time of application, all income I was receiving was child support adjudicated in the divorce decree and I was paying living expenses as well as school tuition with credit cards that eventually were maxed out to the limit.

Attached to this addendum I present the following documents:

- copy of letter from Texas Department of State Health Services certifying the assistance received from the program WIC as well as the duration.

- copy of USCIS “NOTICE OF DECISION” on my Employment Authorization application being denied.

For the second part of the question referring if I am likely to receive public assistance in the future, the answer is NO.

If it was for your USC son, and not for you, are you sure that you need to answer "YES" in the first place?

WIC assistance program in contemplated in the criteria for Public Charge in uscis.org as not being a reason to be denied the permanent recidency. My toddler son would not drive himself and fill up the forms to get approved so my name appear in the application. With the full understanding that we MUST answer with the truth to every single question, I was advised not only here in the forum but by an attorney to declare the assistance received. To my good luck this type of assistance WIC does not fall into the grounds of Public Charge and will not affect me in a negative way, as if I knowingly and willingly conceal the information, they find out at some point and then I am screw for misinterpretation. This is why I do not want to take the risk to be in that position.
