It's sad that one has to stay in physically abusive relationship up to the point of suffering mental effects from the deadly acts before they will be believed. The squeezing life out via my throat & 8-10 hits from a big fist of 6ft 210lb male is enough for my 130lb self. I can't bear! I deserve more than that. Thank you all for your suggestions. Very informative. Will keep you guys updated.

My dear I believe you have a problem understanding English.There is a difference between physical abuse (battered) and mental abuse (extreme cruelty).In your first post there is no one SINGLE MENTION OF PHYSICAL ABUSE. If you WERE NOT BATTERED, then you have to prove that you suffered extreme cruelty(mental abuse).Mental abuse is a pattern of CONSTANT threats,degradation,humiliation,degradation,coercion,control etc. The repeated emotional abuse should severely affect the victim's sense of self and of reality.

If one day your husband was yelling ,screaming, calling you names it doesn't mean USCIS will consider this extreme cruelty,it must be a repetitive pattern that you endured for months and months,and you have to prove that, and you must be diagnosed by a psychologist with major depression and or post traumatic disorder.The standard classification of mental disorders used by mental health professionals you can find in the The Diagnostic and Statistical Manual of Mental Disorders (DSM).You didn't agree with the lawyer said and what with you read here,but keep in mind you are entitled to your opinion, but not your own facts.Physical abuse you don't have to show a pattern,if you were abused once is enough to claim that you were battered,but extreme cruelty YOU MUST show a pattern. USCIS didn't create the standards,nor did I. It's specified in The Diagnostic and Statistical Manual of Mental Disorders (DSM) .

I believe she stated that she was assaulted once, before she left the home, including the jail time for the husband.

If you choose to file the waiver based in extreme cruelty you don't need a divorce decree, if you decide to file based just in bonafide marriage then you need a divorce decree.
