I-130 Proof of citizenship?

Hi folks,

I am applying to AOS from a TN status. I am in the final stages of assembling my package when I realized my husband's passport expired recently.

I'd planned to submit both his passport and birth certificate as ID and proof of citizenship. In the instructions it provided a list of what constitutes proof but I could see interpreting it as either needing only one document or as many as apply.

Should we leave off the US passport or include it with a note on the cover letter that we are renewing his passport and will have it if requested?

I don't want to delay my application for his renewed passport as MY Canadian passport expires in October and I'm waiting for my greencard process to be done to apply for my replacement (am I correct in assuming I cannot apply for my new passport while I wait?).

I'm not 100% sure, but I believe they only require 1 document to prove citizenship. So don't worry about his passport.

As for yours, you're not allowed to leave the us while your AOS is processing, but there shouldn't be any reason you couldn't renew your passport during the process. Worst case, you bring both passports to your interview (the new one and the expired/cancelled one. That way your temporary visa (that you'll have until your green card arrives) can go in the new passport. (I'm assuming that they still issue the temp visa, even though you're already in the us. )

Thanks folks. Regarding my passport my I-94 and current passport is in my maiden name. Should I wait until I at least get my EAD to get my passport? I was advised not to change my name until I have my GC as my SSN needs to match my documents. Or does it matter as my I-94 would still match my initial passport. But perhaps I'm over-thinking.
