My fiance just got his K1 on Tuesday and will be moving here this coming Monday. A few questions as I am new to this forum... 1. We don't need to to file an I-130? Just the I-485, EAD, etc??? 2. Can the EAD be filed at the local office? I know that you could do this in the past but see no reference to this on the EAD instruction sheet.... 3. My fiance will be coming from Mexico thru Newark and on to Boston. Does anyone here have any experience with the Newark POE? Do they give a work permit stamp? 4. My fiance had vaccinations just done a few days before the consular interview (his mother's a nurse) and the doctor accidentally gave him a chickenpox vaccin. although he had had one previously. Consequently, he has come down with something like shingles. Since he didn't have any vaccinations at the medical exam, I'm worried that the doctor here might insist on giving more vaccinations (he's bringing a certfic. of his last vaccin. but hasn't gotten his complete history). Is there any way to avoid this?

You do not need I-130, just make you marry within the 90 days. You can read the guides and get all the information you will need. You can submit application for AOS, once you are married and have all your supporting evidence ready. About the vaccines. If your fiance has his exam and immunizations you will need to go to a civil surgeon that will do the vaccination supplement I 693A for him. Just make sure you call around and get a price for just that, the medical exam he had will be good for a year.

3. My fiance will be coming from Mexico thru Newark and on to Boston. Does anyone here have any experience with the Newark POE? Do they give a work permit stamp?

I entered the States at Newark POE on Dec 3, 2006. I waited in the visitor line for about 40 minutes. When it was my turn, I walked up to the officer. I handed him the brown envelope, my passport and I-94. The officer said, "Oh, K-1 visa. Are you getting married?" I said yes. He scanned my passport (or visa, I don't know which one), then he shouted "Escort!!!" He gave me the brown envelope and everything back and told me to follow another officer.

I was taken to an elevator. It went down 1 floor to another part of immigration. When I got off the elevator, another officer walked toward me and took the brown envelope and my passport. He escorted me to a seat and handed my stuff to another officer at the counter. 2 minutes later, my name was called. The officer told me to get married in 90 days and he handed me a booklet of EAD. Then, he stamped the expiration date on I-94. He gave me my passport back and said I was good to go.

He didn't open the brown envelope in front of me. And I didn't get an EAD stamp on my passport.

Thanks for the info, novia and James n Naina. Any possibility of going to local INS - I mean DHS - office to file for the EAD if he doesn't get the work permit stamp in Newark?

I've never heard of anyone going to the DHS office to file EAD. The instructions on the AOS form indicate that you mail all applications (AOS, EAD, etc.) to the lockbox in Chicago.

When Digna came thru San Francisco on Dec. 29 she did not go thru special processing. The officer did not speak Spanish and she does not speak English. They just stamped her passport and pointed towards the exit door. No EAD stamp either. In fact, she was one of the first one's thru the door......And no other info provided either.....go figure!

Hi devilette-

Thanks for your devilish reply. I did, in fact, use my search button. I asked about the local office because I had actually gone with several people to get there work permits (the same day), here at our local office in Boston. The last time I did this was approximately 3 years ago. I asked about the vaccinations because, the vaccinations were not administered at the medical clinic prior to the consular interview but rather, at his own doctor's office in Mexico - and, although he had previously had a varicela vaccination, he was mistakenly given another one and is consequently recovering from shingles. I hope to avoid a similiar situation and my question was about the weight given to such vaccinations by a civil surgeon here. If my questions offended your sensibilities, accept my humble apologies.

Using my search button, I refer to the following FAQ from this site regarding local offices and the EAD:

5.3)...How about employment? When can my fiance(e) begin working?

A..(generalized statement)..In principle, right away. It is currently unclear if a K1 can legally obtain employment without an EAD during the validity of the K1. One newsgrouper (Aug 2001) reported working without an EAD in this fashion, however, an inquiry to a local office (San Antonio) produced the answer that an EAD is still required. This particular office advises to visit them immediately after entry to the US to obtain a free 90 day EAD. Several local offices will do this. Just walk in there or call them on the phone and tell them you are a K1, and did not get work authorization at the POE. The newsgroup has reported many successes by determined K1-ers who have done this. In order to be employed, it is also required to have a Social Security Number. A K2 still requires a specific work authorization from the USCIS (INS) to obtain a Social Security number. Any "90 day" employment authorization lasts only as long as the valid K1/K2 status (90 days from entry as noted on the I-94). This can often leave a "gap" of time between the expiration of the K-1 and receiving your EAD after you file for it. During this time you cannot legally work. For this reason most people decide to wait until after they have married and filed for Adjustment of Status (or at the same time as this) to submit an application for an EAD so that they may work.

To get a temporary work permit the POE is JFK. My guy just went through there last Thursday and got it. Most people have no trouble. They questioned him for 40 minutes. If you want the temp work permit change the entry to JFK.

You cannot file in person in Boston. Everything has changed.

WE ARE DONE!!!
