Mom from Philippines Denied of a tourist visa

Hello everyone! My mom was interviewed at U.S Embassy-Manila for her application for a tourist visa 5/12/14 and was denied.I am an LPR and entered the U.S as a k1.We wanted her to visit us this summer since this is the best time for road trips and theme park visits.My question is:When can she apply again for a tourist visa?Is it ok if we let her apply again ASAP?(like next month).Thanks in advance for your answers.

She can apply as many times and as often as she wants.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

If nothing has changed about her circumstances she will most likely get the same answer. Has she ever traveled to other countries ? It helps with other travel to places that show she obeys the limits of a visit

This will not be over quickly. You will not enjoy this.

You travelling to her is likely going to be your only solution for the immediate future.

Sometimes, it is just hard to get a tourist visa. My mom is here with me now, but I did not apply her for a tourist, but an immigrant visa because it is much faster, and I knew my mom will be approved, but you can keep trying to apply her for tourist visa, or you can wait till you will be a US Citizen which you can apply 3 years after you received your green card. Petitioning a parent or parents is much easier.

Whether somebody 'deserves' a visa or trip to the US is not relevant; what is relevant is what the CO believes about the bona fides of the applicant...will they return when they say, will they refrain from working (including babysitting grandchildren), etc...that is what matters.

I would agree that reapplying fairly soon is not likely to succeed, because how could her circumstances change appreciably in so short a time? However, it's only $160 or so to find out.

Hi Fil-Am, I have the same situation with you, but right now I'm still just planning and researching on how I can get my mom here, I just want to know if your mom have a business or show any bank account in the philippines during her interview?, because my mom doesnt have any assets, bank account that have enough money on it to show to the consular so I guess If we try to apply visa for her shes gonna get denied too :( Btw, I'm 10 years LPR and Im sorry btw your mom got denied)

Hello Fil-Am,

I empathize with your family member receiving their denial, my mother-in-law and three other family members were also denied. The USEM B1/B2 visa refusal rate in 2013 was 25.4%.

See my post/thread on 07 May titled "B1/B2 Visa's U.S. Embassy Manila". Two posts intimate that having a prior travel history won't have much impact on the CO's future decision per se. Having said that, I agree with the posts here in that unless their circumstances change between the time of their first application and any subsequent ones, approval might be a moot point. But, stranger things happen and I've read posts of subsequent approval regardless of how long they waited in between applications. It's factually true that it will cost them $160 to find out if they'll be approved on their next attempt.

Perhaps they'll receive approval on their future application.

Thank you all for your replies.I appreciate it very much.My mom came to the interview well prepared.She has all her paperworks-house and land title,bank account,letter stating she is the guardian of my nephew...etc.But the CO didn't even bother to check or look at her documents.My mom is already 66 yrs old and don't really have the intention to stay longer than 2months here in the U.S. Oh well,maybe visa issuance really depend on the hands of the CO.My husband and I already decided to let her try again a month from now.I'll let you all know if she gets a visa or not.Thank you.Thank you all.

Most of the time the decision is made before you walk into the embassy, you're just going to hear whatever decision has been made.

Sad and unfortunate, but probably an accurate and true statement; especially in light of the OP stating that none of her mother's documents were looked at. I'll give her the benefit of the doubt and believe her statement is accurate as I gave my mother-in-law the same benefit when she articulated the same occurred at her interview. Yes, ANYTHING, any document can be faked so bringing those types of "proof" seems not to matter. To my knowledge, there isn't anywhere on the application where one may indicate what (if any) proof or documents are available for the CO to peruse if requested.

As you pointed out, most of the time the decision has been summarily made before they walk into the embassy.

They've a tough job to do, but I'm glad they're there to protect the interests of the United States.
