My joint sponsor makes enough on her own to sponsor my relative, but she filed her taxes as married and filing jointly. How does the i-864a need to be filled out?

Her spouse did have income as well. Just incase you're wondering. We do not live in the same household.

She might not need to have the I-864a filled out if she can prove her income alone is enough. Just provide W2's along with the tax return transcripts.

My joint sponsor filed jointly as well and she is providing me her W2's so that her husband doesn't have to fill out any paperwork.

Of course I don't know if they will accept it yet because I have not submitted my AOS package yet. Maybe someone else can give better direction than me.

It's better to send the entire tax return vs the transcripts with W2, but that the latter is an option. The easiest option is obviously to have her husband complete the I-864a, but if he doesn't want to, it should work out okay. The CO might be curious why a husband and wife are not agreeing together to joint sponsor since this is a major decision.

I do have the joint sponsors w2's and tax returns and her pay stubs but she scratched out the numbers for the amount being deposited lol. She's really annoyed about NVC getting in to her business. :-)

Just curious because the i-864a looks like an application to make the spouse another sponsor..is this correct?

If yes, do we have to check the box saying there are two joint sponsors?

No. It's combining the income of household members. it's not an application for anything.

They count as one joint sponsor because their household income is one household income.

Last question..I think. The i-864 asks for the amount of people in the household and then it says if you have a spouse put 1, but what if the immigrant you are sponsoring in that particular affidavit is your spouse? Aren't they being counted twice?

nope. You put zero in the spouse spot if you're sponsoring a spouse.

So the same thing for a stepchild who is a dependent? We have 3 children whom are dependents, so for the affidavit for the stepson we will only put 2 dependents

We used my husband's father as the joint sponsor, he filed his taxes jointly with his wife for 2 of the past 3 years. We only provided his W2s and paystubs, his wife didn't fill anything out. So far no RFE. My brother on the other hand filled it out exactly as we did (using his wife's uncle) and he got an RFE asking for the uncle's wife's info. I think it all depends who is looking at your case. If we had known before we filed that my brother got an RFE for it, I would of put the wife's info as well.

This is exactly what we are trying to avoid. We haven't received the NOA2 yet, because we just got notification that we got an RFE. Not sure HOW, because we sent sufficient info IMHO. Smh I really DESPISE that they are making me wait 15 days to find out what it is they want.

I REALLY hope that's what it is, because im over here going nuts! I realized that if not for my RFE I would've most likely been receiving an "approved" status instead....maybe.
