I got a 10 year green card under F21 category. (My marriage date is 29th December 2011 and POE is 5th April 2014). So its more than 2 years. However, my husband became a citizen after my interview and before my POE. Should my category change or should it be F21 only since we never upgraded our petition?

I think your GC is fine as it is because the visa was issued before your hubby became USC.

thanks apple21. my interview was on march 6, 2014 (visa issued the same day) and he was sworn in as a citizen on march 28, 2014. my poe was april 5, 2014. I called the uscis number. she told me to schedule an appointment with the local uscis office to inquire. Am still confused.

Allright. Just came back from infopass. IO was good and she gave me some info.

Apparently, 2300 Green cards were erroneously issued with the wrong expiry date(Was even given 20yrs validity). But my wife's green card did not come under that batch where the date of expiry is wrong and at the same time category should not be F21 but CF or something like that (Because its a conditional Green card)

I filled out the I-90 at home and took the supporting docs but she told me to wait until i heard back from TSC. She filed a Service request to TSC right then and there and gave me a Referral number and told us to wait till June 19th to hear back from TSC. If i don't hear back from them on what needs to be done by June 19th(IO thinks mostly i have to file I-90 and send it across) i need to call USCIS and escalate it to Level 2.

IO thinks this error comes from a particular batch only off late and creating the service request and letting them know will fix the issue once for all on their side.

So for now all i have to do is wait till June 19th for a response from TSC and go from there. I have everything ready and once TSC responds i will send them I90 if that is what is required.

IO told me that i did the right thing and if i had done nothing it would create problems if i did not file removal of conditions after 2yrs and would have put my wife's status in jeopardy.

@vkrishn your wife still under f2a category or did you file for naturalization before she got her gc,,?, I dont understand why io told you that you wifes category must be cf something not f21??

I am still an LPR. IO at infopass told me since our marriage was less than 2yrs at my wife's POE they need to give her a Conditional Resident card for which the category even though she came under F2A (F21) has to be CF or something like that in the card to indicate that she is a conditional resident.

CORRECTION: My GC and visa is FX1.

I did a little google-ing and it is for Spouse of Permanent Resident. http://travel.state.gov/content/dam/visas/Statistics/FY2001%20app%20E.pdf

For F21 it should be C21.

For FX1 it should be CX1.

C21 and CX1 are for Spouses of Permanent Residents - conditional.
