Applying for Adjustment of status and work permit...

Timeline

Hi.

So, i entered The states 10th of february, on a k1 visa. we got married april 18th, and we havent yet filed for adjustment of status, hopefully we will soon. My question is , is there like any time frame where we have to apply for it? And also, after getting married, is there anything else we have to do, or they will see that we got married and that its registered?

Timeline for our K-1 Fiance Visa:

09-27-13: Sent to Texas Lockbox

09-30-13: Recieved by USCIS - Confirmation sent by email

10-03-13: NOA1 from USCIS by email

10-15-13: NOA1 , hardcopy recieved

10-24-13: Alien registration nr was changed

11-12-13: NOA2 from USCIS by email

11-18-13: NOA2 , hardcopy recieved

12-04-13: Our case was shipped to NVC

12-10-13: NVC recieved

12-13-13: Got NVC case nr

12-18-13: Case sent to embassy

01-17-14: Medical exam.

01-23-14: Interview appt.

Actually, there is no written time frame when one has to do AOS. However, once the I-94 is expired (90 days after POE), the intending immigrant is out of status and technically detainable or deportable, until a NOA for I-485 is received.

The waiting is money, i think we weould apply within two or three months from now, hopefully sooner. I only "overstayed" days as it is now, so i hope we will be fine! :huh2:

You're welcome. It seems to be quite common. However, as mentioned in that thread, it is best to have it done earlier and borrow money if needed, so you can be able to get to work soon as well. In the long run, the financial return is better.

Many people here have advised that you should filed AoS within 90 days from admitted to the US. Yes, there was a guy detained and went to court because he did not file AoS yet. But, he was lived in the border and people get more scrutinize since many illegals cross the border at any time.

As far as my knowledge, the lady in the Window 5 at the US embassy in Jakarta told me that, " I have to marry my petitioner within 90 days", not ," I have to file AoS within 90 days". Married to the US citizen is not a solid guarantee your immigrant status is being granted but it does not mean they will deported you easily. The guy was detained for many hours, went to the court, and the judge ordered him to file AoS as soon as possible - as far as I remember correctly the story-.

I am out of status now as well and do not file AoS yet because I'm still waiting my certified marriage certificate that usually takes up to 3 weeks comes via mail - I already have filled out all the papers for AoS and just waiting for our marriage certificate-. Key West is a small city and I went out here very often. I only bring my passport, ID pass for military's spouse, and a copy of my marriage license.

Hello!

I have a question. I got to the US on a K1 visa on the 7th of March, got married to my American fiance on the 26th of March and soon after, like at the beginning of April, I think (dont remember the exact date), we filed for the Work Authorization document (which still hasnt arrived). We didnt file for AOS yet because we didnt have the money at the moment but now we do and we're getting everything ready and want to apply by the end of this month.

I now realise I made a mistake when filling separately for that Work Permit because we paid over $300 for it while if we had waited and filed it with the I-485, it would have been free of cost. But anyway, that s done now. After we sent the Work Permit application, they sent an envelope with an appointment for biometrics for the 6th of May. I already had my biometrics done (fngerprints, photo and signature) so now my question is this: When I sent in the I-485, what's the fee that I have to pay, is it still $1070? I understood that in those $1070, they include the $80 or $85 biometrics fee but since I already had that done, do I still have to pay that fee? How can I prove that I had my biometrics already?

Really? But I havent even received it yet and it's going to expire at the beginning of June nonetheless?! That's crazy.... That means that applying for it and paying that fee was completely pointless
