I am currently living in the US with my husband and our son. I have been here since September 11th, married since November 1st. We have been back and forth with the I485 (RFE's) but looks like it is finally processing. However, we have decided this isn't the place for us, and the three of us have decided to move back to the UK. The plan is for us to go over in December, though my husband will return to the US for 5 months whilst he finishes his degree. My question is, what happens in this case? If I do not receive my green card before December, can I just go? Will it affect my ability to visit in the future? Or will I just be able to come over as a normal visitor?

If you don't finish the process of removing of conditions, fail to send additional documents etc., and miss the deadline for doing that, the petition will be denied, you will lose your resident's status and will be coming to the US in the future as any other UK citizen.

If they approve your petition, they might send you the card by mail, when you are already back in the UK. Then you can have someone get your mail and send you the card to the UK. But for keeping the resident's status you must not stay outside the US longer than half a year. You will have to travel back and forth to keep your status.

You shouldn't just leave your petition in limbo. Either formally request to withdraw the petition or finish the process. Like poster above stated it will show as denied if you don't do anything and that will look bad for you in the future if you decide you want to move back.

Thanks for your replies. I didn't intend to just leave it hanging, I would inform them either way, I was just wondering if doing so before the visa is approved would affect future visits. I can't see myself moving back here in the future as a resident, only for tourist reasons, so not too worried about losing my status.

If you inform them then they'll just cancel the whole process and you'll have no problem of coming back to the US as a visitor at all in the future. If you don't inform them, and they process it, and deny you, then you might have a problem. But looks like you are a smart cookie, so I am not worried about the steps you're going to take. :) And eyyyy, say hi to ol' Europe for me! :) Take care!

My ex and I did the same thing back in 1996 -- an offer in the UK we couldn't resist during AOS -- and abandoned the process. He'd accrued fewer than 180 days' overstay at the time we moved back to the UK. We informed our local office, where some idiot said everything would be transferred to the London consulate for us to finish up there, so we didn't need to do anything more except contact the consulate after we had moved back to London. Well, you imagine how successful that was! :lol:

Fast forward 7 years, my ex had been using the VWP with no issue until Christmas Day 2003 when he was detained at Newark Airport (I'd flown ahead a week before to visit family, and he was joining me on holiday). He basically cajoled CBP into letting him in (helps to be a white, English-speaking, well-heeled lawyer, I guess), but he was warned that while there was a record of his overstay in 1996, there was no record of his AOS application. All they could see was overstay, so he was now required to get a B1/B2 visa. He got one with no issues, but it was still a pain.
