My friends husband did not have a job for the last 3 years. And after he (USC) married her, he find jobs and has been working in 2 jobs recently. Now that they are filing for CR1 they have his mom as joint sponsor. He has only worked for 5 months now. Are they going to be fine to get approved?

It does not matter that he had 0 income last year (or years before). He still files the I-864. His mom will file a I-864 as the joint sponsor, and hopefully her income will be enough to qualify all of them.

Thank you for this. This applies to us too as we will be filing CR1when he finishes school and gets a job. If the job doesn't pay enough to qualify (although I really hope it does - all those school expenses need to be worth it!) then his family will co-sponsor. But it's good to know it doesn't matter if he didn't work or earn beforehand (he did, but only odd jobs while at school - in restaurants, etc that paid very little).

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

By the time the affidavit of support is submitted, he will have worked several more months. It is a common misunderstanding that because the affidavit of support asks about past income information from tax returns, that past income is a big factor in the public charge decision. Current income is KING. If his current job pays enough to qualify, he should not need a joint sponsor. If it doesn't, then a qualified joint sponsor is OK, generally. Elderly parents are not the best choice as joint sponsors though. (By Elderly, I mean over 75.)

Facts are cheap...knowing how to use them is precious...
