So I've gotten all the bad stuff out of the way, crossed an ocean, married my lovely wife and am in the process of filing the I-485 but unfortunately am finding that not all my paperwork made it here together. Reading the instructions for the I-485 it asks for a copy of the petition approval notice, a copy of marriage certificate and I-94. The approval notice I'm assuming is the NOA2. I have my interview letter which includes my case number, the type of visa I'm applying for (K1) and so forth on US embassy paperwork and I have the checklist that came in the NOA2 pack, also on embassy paperwork but not the NOA2 itself. I am hoping that as the interview letter contains all the relevant information about me and is the step immediately following the NOA2 it would be acceptable as evidence of eligibility, when combined with marriage certificate and I-94. Section 10 of the instructions doesn't specify NOA2, it just asks for proof of application for an approved K1 application, a legal entry to the US and of the marriage.

Thoughts?

You are filing for AOS from K1 visa and your I-129F petition approval NOA2 is missing?

I applied for the K1 to get married to the girl I am now married to. K1 was accepted, entered the US on a K1 visa, married the girl, living the dream, applying for a change of status now.

The NOA2 should be in your wife's paperwork since it was mailed to her. No reason you would have had it. Have you looked through her stuff? It is the paper that told her the I-129F petition was approved last November.

Agreed with Nich-Nick. Check it with your wife for the paperwork she received from uscis. NOA 2 (I-797) looks like this: http://imigrantengfilipina.files.wordpress.com/2011/07/noa2-scaled7501.jpg?w=640&h=800

This is the mailed letter from uscis before NVC's letter.

We never received the NOA2; I printed out the emails I was sent saying that the file had been approved & transferred (and then the one a week later showing the hiccup in the system, when I got the exact same message for a second time), as well as all the Consulate emails, and then wrote a brief note explaining we never got the letter and when called, were told we didn't need it but could pay if we "wanted the security." We're in the "twiddling our thumbs waiting to see what happens" part of the AOS (waiting on EAD/AP and all that fun), and if we get a RFE, will follow the instructions for infopass in the link provided above: http://www.visajourney.com/forums/topic/323385-filing-for-aos-with-lost-noa2/

Seems like it's pretty common though, so I'm not terribly worried about it. (It strikes me as an odd requirement, too - I mean, the Consulate got the paperwork, gave him the VISA, we got married,... I'm PRETTY sure there was an NOA2 passing paperwork along the line, all things considered!)

Good luck. :)
