hi everyone just want to add to my research, can i file for my brother with a finnish passport who is on a visit in the USA.he came in on a visa waiver and does that mean he needs to return to finland before he can be filled for?

It doesn't matter. You will put his address in his country, the petition takes 12 years

he can come to visit but he can't overstay his visit

After you file the petition there is a 13 year wait based on what is going on now. Many expect that wait to increase in the future. Because a sibling is NOT an immiediate relative for immigration overstays are NOT forgiven and any overstay of VWP prohibits future use of VWP. Only the children that are still under 21 will come with the brother . There is no way for him to stay nor for the children to attend school here now

This will not be over quickly. You will not enjoy this.

Mum yes you can file for her. It will take maybe a year. But brother as people have said 12 to 13 years.
