im thinking about planning a trip with my wife she has been in the country for 3 months on a k visa and i was wondering if she could travel outside of the US and come back without any problems ??

She can leave the US at anytime. The trick is re-entering the US. To be allowed back on the airplane your wife will need to show either 1) EAD/AP (Employment authorization. Advance parole combo card or at least the AP), 2) the GC, or 3) a valid visa for travel to the US. Since she is a K-1 visa holder, and has already entered the US using the K-1 it is not longer valid for travel as it is a one-entry visa only. She has gotten married and fulfilled the requirements of the K-1 visa. Now she must file for adjustment of status (AOS) to become a LPR (lawful permanent resident) of the US. Until that happens, she cannot work or travel without proper documentation as in item #1 or item #2 above.

That is the long winded answer to your question. The short and simple answer is: she will not be allowed to re-enter the US.

Good luck,

Dave
