How can you not know that you are not a citizen? If you are a citizen, you have either a birth certificate or a certificate of naturalization. Moreover, you were either born a citizen or became one at some later date. This man is either too ignorant to be a a competent member of society, delusional, or lying. This should have come up every time he had to fill out an I-9. I understand that our system is woefully inadequate when it comes to catching things like this, but that isn't how he's supposed to find out. Imagine getting pulled over and then trying to claim that you thought you had a driver's license. I just figured I must have gotten a driver's license at some point. Everyone would assume that you are either mentally impaired or lying. Same thing here.

He's was not an illegal alien.

He arrived legally and was eligible to adjust status under the Cuban adjustment act. His parents filed the paperwork for themselves and eventually became US citizens but for some reason, failed to do so for their 9 year old son.

He may have become inadmissible, but there is no way they will send him back to Cuba.

He claims to have taken the oath citizenship and appeared before an immigration judge while serving in the military during the Vietnam war. This would qualify him for citizenship automatically and historically it's a fast track process, often done in a single day. Problem is he never got his naturalization certificate and when they subpoenaed his records, the military has no record of the event, although they do have his service records.

The case was refiled and is currently under review.

It appears you are not familiar with how the INA applies to Cuban nationals who reach US soil.

Why don't you be a dear for us and Google up some response that makes you sound like an Immigration lawyer, and really put me in my place. run along now son and do that

My wife just applied for her 10 year green card.She came her legally on a K-1 and successfully adjusted status.

Even though she came here legally if she did not file ROC and her 2 year Green Card expired, guess what she would be

An Illegal Alien.

Cuban nationals are not subject to the same restrictions as other foreign nationals. There is no comparison to your wife or anyone else.

Cuban nationals don't even have to arrive in through a port of entry.

I'm not going to google it for you, but it's pretty easy to look up the Cuban adjustment act and see how Cuban nationals are not subject to the same immigration laws as other foreig nationals.

But the point remains, he is an illegal alien as is any non- U.S. citizen who is not in compliance with U.S. law as it relates to legal residency status, no matter how they got here.or if they were at one time legal, as is the very valid point I made about my wife

Just admit you were wrong about him not being in Illegal status and move one, it just makes it worse when you try to dance around your ridiculous statement

That's a really convenient story. But at a certain point you're responsible for your own stuff. How did he go 17 years while never realizing he had no documents? How did he fill out I-9 (did he have an unrestricted SS card?)? How did he get an ID/driver's license? Does he even have a social security number?

He was even in the military, which should have allowed him to become a citizen.

For the army to not know he wasn't is unbelievable.

You don't have to be a citizen to be in the Army, or even have an IQ over 50
