I-864 Questions - No Tax returns

Hey Everyone,

I was wondering if anyone could shed some light on my situation...

I am a USC living in Denmark with my Danish wife for about a year now. This past year, I have been working at an unpaid internship and then with another company 1 day a week where I made hardly any money (enough for groceries pretty much). After reading some of these forums, I have just realized that all American expats must pay US tax still. But i have also seen that you might not have to if you don't make enough money. Anyone know the ruling on this?

Will I have to send the I-864 forum before my interview or will I get the chance to explain my situation to someone? The reason we want to move is because I was just offered a job in the US; so maybe showing a new job contract could help?

US Expats are under the same tax "filing" not "paying" requirements of those living in the USA. Check the filing threshold to see if your income requires you to file. If it does, there will be no tax on the first $90k plus of foreign income. If your income is below the threshold, simply indicate you were not required to file due to income below filing threshold. You can hand write this directly on the form.

US Citizens don't have interviews in the visa process for their spouses. However, yes, you will need to deal with the sponsorship issue either by returning to the USA and beginning your new job or finding a qualified joint sponsor. Either way, you submit and accurate and complete I-864.
